MGI Reports To Police, Alleged Counterfeit In MCI Necklace Brand

JAKARTA - PT Millionaire Group Indonesia (MGI) has reported the perpetrators suspected of committing a criminal act of brand counterfeiting of the MCI pendant necklace at Polda Metro Jaya.

This legal action was taken because PT MGI had suffered billions of rupiah in losses due to the sale of counterfeit products under the MCI brand which also resulted in a decreased turnover.

"The findings in the online market and marketplace are that every day there are more and more actors everywhere trading counterfeit MCI branded products and there are also actors who dare to use the name of the product they are selling is the original MCI brand. As a result, there is a sharp decline in turnover from clients us," said PT MGI through its attorney Beny Nurhadi, and Deny Mulyana Suhanda, SH from the Legal Solutions Law Office in Jakarta, Thursday, December 30.

The report recorded in the Police Report Number: LP/7422/XII/YAN.2.5/2020/SPKT PMJ dated 14 December 2020 is a follow-up to the trademark counterfeiting complaint letter dated 9 November 2020 by the Director of PT MGI, namely Yohan Wibisono.

This report is related to alleged criminal acts in the field of marks, as referred to in Article 100 paragraph (1) of Law Number 20 of 2016 concerning Marks and Geographical Indications.

The incident occurred around November 2020 in West Jakarta with complaints of trademark counterfeiting which were found to be sold by the perpetrators without permission from PT MCI through online markets and marketplaces.

Beny recounted that the case began when the witness was looking around on social media who was selling a pendant necklace type life scret man brand MCI.

Then the Witness bought the MCI brand pendant life scret man necklace around November 2020 through the online shop in the shopee application with the account name riniishopindo, through the webgenerationgoldindonesia.com and biotherapy.life.

"The witness then checked the pendant necklace and it turned out to be fake," said Beny.

The witness then submitted this matter to the Legal Solutions Law Office through Ardy Susanto, SH as Managing Partner and was followed up by reporting the findings to Polda Metro Jaya.

Beny explained that the Polda Metro Jaya investigators had conducted an examination of the Reporting Party and the Reported Party and then proceeded with the Case Title with an increase in the status or determination of the witness to become a suspect with the initials N, SM and HTB.

And the examination of the suspect has also been carried out by summoning the three for questioning.

"According to the latest information from the investigating investigator, the case files have now been sent to the DKI Jakarta Prosecutor's Office," he explained.

PT. MGI sees and believes that the legal process that has been carried out by investigators from the Polda Metro Jaya should be continued without neglecting the restorative justice process that has been taken.

This is because the sale of counterfeit products with the MCI brand has an impact on declining turnover.

"We emphasize that our products are not sold online but are sold by becoming a member first," he explained.

"With the existing facts, we believe that more real and serious action is needed in handling cases of trade in counterfeit goods for the MCI brand," he added.

One of the efforts is to carry out this case perpendicularly according to the applicable law in order to deter and serve as a warning to other perpetrators. Thus, it is hoped that the seriousness of handling this case to the perpetrators who sell counterfeit MCI brand products will decrease.

We hope that no one will sell without the permission of PT MGI. We are determined to fight the perpetrators who sell our products without permission," he explained.

In the same place, Deny Mulyana Suhanda's attorney hopes that what is being done now will have a deterrent effect and can serve as an example to other perpetrators.

"Because we will report anyone and process according to the laws in force in the Republic of Indonesia for perpetrators who are still stubborn in selling our products. The point is we will not compromise if there are violations," concluded Deny.
