JAKARTA - The Ombudsman of the Republic of Indonesia admitted that he was surprised that the Corruption Eradication Commission (KPK) and the State Civil Service Agency (BKN) compactly objected to the findings and corrective actions submitted by his party regarding the implementation of the National Insight Test Assessment (TWK).

This test is a requirement for KPK employees to become State Civil Apparatus (ASN) in accordance with the mandate of the KPK Law Number 19 of 2019.

"Yesterday we were surprised, frankly, even though we prepared the room for such a procedural. Because the KPK and BKN use that as their position as the reported party," said RI Ombudsman member Robert Na Endi Jaweng in an online discussion entitled September Gray at the KPK: The End of Fate Corruption Eradication? which aired on YouTube Friends of ICW, Sunday, September 19.

According to him, although the procedure for filing an objection is indeed given by the Ombudsman, it is usually the reporting party who is not satisfied with the final decision.

While in the TWK polemic, the KPK and BKN were the reported parties, while the anti-corruption commission employees who did not pass the TWK were the reporting parties. "But okay, we respect that because we give the room," said Robert.

Despite the objection, the Indonesian Ombudsman saw that BKN had taken the corrective steps given after the discovery of maladministration in the TWK process. This can be seen from the start of making a roadmap for the transfer of employee status from independent to ASN.

"I have conveyed progress towards BKN, from our final report even though they objected but BKN has made improvements to the preparation of the roadmap for the process of transferring employees to an institution not only the KPK, because maybe one-day Komnas HAM or the Ombudsman will become ASN. Because so far they don't have one," said Robert.

"So the BKN doesn't have a roadmap, it doesn't have any measuring tools, it doesn't have an assessor, it doesn't have everything to make the transition like the one at the KPK," he added.

Meanwhile, the KPK, said Robert, did not respond to the corrective actions that had been submitted by the Indonesian Ombudsman.

As previously reported, the Indonesian Ombudsman found administrative violations and abuse of authority in the implementation of the TWK.

There are four corrective actions that should be carried out by the KPK, namely asking the KPK leadership to continue to transfer the status of Novel Baswedan and 74 other employees who were declared not to have passed the TWK to become State Civil Apparatus (ASN). Next, the Ombudsman asked the KPK not to use TWK as the basis for the dismissal of 75 employees.

Then, the anti-corruption commission was asked to carry out official education regarding national insight for employees who were terminated because they did not pass the TWK. Finally, the KPK was asked to explain to its employees about the consequences of implementing TWK in the form of information or legal documents.

Corrective actions were also conveyed to BKN which was deemed not to have the capacity to carry out TWK. However, BKN actually considers the findings of the Indonesian Ombudsman to be incorrect.
