JAKARTA - The decision of the General Chair of the Indonesian Reformist Youth Leadership Council (DPP AMPI) to carry out the Inter-change (PAW) of the Secretary General, General Treasurer, and a number of trustees for the 2022-2027 term has attracted attention.
A number of managers assessed that the process was suspected to be inconsistent with the Articles of Association and House of Representatives (AD/ART) and Organization Regulation Number PO-004/DPP-AMPI/07/2022.
Based on an internal study of the AD/ART AMPI for 2022 and the Organization's Regulation on the Determination of Vacant Positions, Inter-Time Replacement (PAW), and Repositioning of AMPI Manager Personnel, the decision was considered not to meet the constitutional mechanism of the organization.
The study said there were allegations of disregard for the principles of constitutional supremacy of organizations, collective-collegial, due process of organization, and good organizational governance.
Chairman of the Organization Sector of the AMPI DPP, Wahyu Hamdani, emphasized that all managers, including the General Chairman, are obliged to comply with the AD/ART and Organizational Regulations.
"Organizations should not be run based on one person's will. AD/ART is the highest constitution of an organization that must be obeyed by all managers without exception. When the constitution is ignored, what is at stake is not only the legality of decisions, but also the legitimacy of the organization's leadership," he said.
According to Wahyu, the AD AMPI places the Central Leadership Council as the highest executive body that works collectively.
Therefore, the decision regarding the PAW is not the absolute authority of the General Chair, but must go through the mechanisms regulated in the AD/ART and Organizational Regulations.
The results of the organization's study revealed at least five points that were considered to be a concern.
First, Organization Regulation Number PO-004 stipulates that decisions regarding vacant positions, PAW, and personnel reassignments must be decided through a plenary meeting that specifically discusses the agenda by taking into account the proposals and suggestions of the Board of Trustees. However, according to the study, the mechanism is suspected of not being carried out in full.
Second, the basis for determining the vacancy position is questionable. The Organization's regulations limit the reasons for a position to be declared vacant, such as death, resignation, loss of membership, duplicate positions, inactivity after being given a warning, or taking actions that harm the organization according to the applicable mechanism. Meanwhile, the dismissed manager is said to have never resigned or lost his membership status.
Third, the dismissed manager was said to have never received a Letter of Warning or a Warning Letter, although the mechanism is required if the reason for dismissal is based on inactivity.
Fourth, the dismissed managers were also said to have not been given the opportunity to use their right to defend themselves before the PAW decision was issued.
Fifth, the decision was allegedly not through the consideration of the Board of Trustees as stipulated in the Organization Regulation.
Deputy General Chair for Organization of the AMPI DPP, Muhammad Safii, assessed that the series of processes have the potential to lead to abuse of power in organizational governance.
"The authority of the General Chairperson is not unlimited authority. AD/ART has regulated that the DPP is an institution that works collectively-collectively. When strategic decisions are made without fulfilling the constitutional procedures, without the basis for the appointment of vacant positions, without a warning letter, without the right to defend oneself, and without taking into account the considerations of the Board of Trustees, then the action has the potential to be a violation of the organization's constitution," he said.
Safii added that any action that is contrary to the AD/ART and Organizational Regulations not only impacts the validity of decisions, but also the legitimacy of the organization's leadership.
"No one is above the organization's constitution. The General Chair is the first party who must set an example in implementing the AD/ART. When the organization's constitution is ignored, the trust of cadres in the organization is also at stake," he said.
Based on the study, Safii assessed that there were reasons to evaluate the leadership of the General Chairperson through the organizational mechanism as stipulated in the AD/ART.
This step is considered important to maintain the dignity of the organization, legal certainty, and the supremacy of the organization's constitution.
Meanwhile, Wahyu Hamdani emphasized that the delivery of this attitude was not intended to trigger internal conflicts, but as a form of moral responsibility so that AMPI remains an organization of cadres who uphold internal democracy, transparency, accountability, and legal certainty.
"We are not fighting against someone. We are defending the organization's constitution. Because a large organization is not built by power, but by respect for the rules that are agreed upon together," he said.
In their statement, they also encouraged the DPP AMPI to open transparently the documents that became the basis for the PAW's decision, explain the procedures used, review the decision if it is proven to be inconsistent with the AD/ART, evaluate the leadership through the organization's mechanism if violations are found, and restore the organization's governance in accordance with constitutional principles, collective-collegial, transparent, and accountable.
