JAKARTA - On the occasion of International Labor Day on May 1, the issue of protecting workers' rights and resolving industrial relations disputes has again become a concern. One of the cases that is currently rolling is a dispute between Edo Rodadi and Commscope Solutions Singapore Pte. Ltd. which was tried at the Central Jakarta District Court, Wednesday, April 29.
The hearing, which took place on Wednesday morning, was scheduled to examine witnesses and present additional evidence from the plaintiff. However, the witnesses who were scheduled to attend from the plaintiff were unable to attend.
The defendant's lawyer, Ahmad Fauzi, said the case began with the company's decision to terminate the employment contract (PHK) of an employee who was considered to have committed a serious violation.
According to him, the layoffs have been carried out based on the provisions of the Employment Creation Law, especially regarding violations that are urgent.
"If the rules are not enforced, then what should we refer to?" said Ahmad in his statement, Thursday, April 30.
He emphasized that the company had carried out all procedures in accordance with legal regulations, including the mechanism for resolving industrial relations disputes and fulfilling workers' rights.
"In terms of procedures, the company ensures that all stages of layoffs have been met in accordance with applicable laws," he said.
The defendant also admitted that he questioned the reason for the lawsuit filed by the plaintiff. According to Ahmad, the argument regarding efficiency mentioned in the lawsuit has never been the basis for layoffs in the case.
On the other hand, the lawyer for the plaintiff, Guru Putra, assessed that there were procedural defects in the process of layoffs against his client. He said that the urgent reason for the violation used by the company had never been legally proven.
"According to our understanding, what is alleged to our client as the reason for the layoffs is not appropriate, because until now it has not been clearly proven," said Putra.
He also assessed that the company did not provide a defense opportunity for workers before the decision to dismiss was made.
"On the same day a clarification was made, a layoff letter was immediately given without any warning letter," he said.
According to Putra, the Job Creation Law places layoffs as the last step after the company has made various prevention efforts, including coaching and issuing a warning letter. However, these stages are not considered to have been carried out in this case.
He revealed that bipartite negotiations between the two parties had been carried out twice, but had not reached an agreement. Differences of opinion include the basis for layoffs and the amount of compensation that workers should receive.
The plaintiffs also questioned the calculation of severance pay and other normative rights which were considered not to be in accordance with the provisions. Meanwhile, the company was said to only provide limited compensation on the grounds of a serious violation.
In the lawsuit, the plaintiff asked the panel of judges to declare the dismissal invalid because it was considered not supported by strong evidence of the alleged violations alleged against the workers.
Meanwhile, the defendant remains optimistic that the evidence they have is sufficient to prove the validity of the company's decision. The trial is scheduled to be held again on Wednesday (6/5/2026) with a continuation of the evidence agenda.
This matter is of concern because it relates to the implementation of labor norms, especially regarding the limits of "urgent violations" as the basis for layoffs in Indonesia.
