JAKARTA - The Ministry of Environment (KLH) said that criminal legal action against the former Head of the DKI Jakarta Environment Service (DLH) was taken after there was disobedience to carry out the sanctions for improving the management of the Bantargebang Integrated Waste Treatment Plant (TPST).

The Deputy for Law Enforcement (Gakkum) of the Environment and Natural Resources Law Enforcement Agency (KLH/BPLH) Rizal Irawan said that gradual steps of guidance and supervision had been carried out before designating the former Head of the DKI Environment Service (Kadis) with the initials AK as a suspect.

"It started with administrative sanctions, then we checked compliance, it turned out that it was not obedient, we did a second warning, it turned out that it was not obedient. We ordered the environmental audit to be non-compliant, so we went through all the stages. He explained that before the garbage landslide that killed seven people in TPST Bantargebang on March 8, 2026, his party had conducted an investigation related to waste management at the location.

Specifically, he highlighted that TPST Bantargebang had been subject to administrative sanctions in the form of Government Force since December 2024.

Supervision of the implementation of the sanctions has been carried out twice, namely in April and May 2025, with the results showing that the manager has not fulfilled the obligations set out.

In addition, KLH/BPLH also requires the implementation of environmental audits, but until the investigation process is underway, there has been no significant improvement in the management of waste management at the location.

Regarding the former DKI Jakarta Provincial Government (Pemprov) official with the initials AK who has been named a suspect, Deputy Gakkum KLH Rizal said no detention was carried out even though the legal process was still ongoing.

"That in Law Number 18 is clear because of the negligence of waste management that does not pay attention to the SPK, which can result in public health disorders, security disorders, environmental pollution or environmental damage that results in death or serious injury, a maximum of five years in prison," explained Rizal.

Not only that, Law 32/2009 also underlines that the person in charge of a business or activity who does not carry out government coercion can be sentenced to a maximum of one year in prison and a maximum fine of Rp. 500 million.
