JAKARTA - The Witness and Victim Protection Agency (LPSK) provided assistance to the family of the deceased Prada Lucky in the appeal hearing for the persecution case that led to the victim's death, to ensure that the victim's rights are still met in the judicial process.

Deputy Chairman of the LPSK Antonius PS Wibowo said that the assistance was carried out to ensure that the victim's family could follow the legal process safely and receive protection while giving testimony at the trial.

"LPSK ensures that SPM can attend the trial without obstacles and can give testimony before the military judge freely without pressure and intimidation from any party. The victim's right to restitution must also continue to be fought for," said Antonius in his statement in Jakarta, Friday.

The appeal trial for 22 accused TNI soldiers was held at the Surabaya Military High Court III-12 on Wednesday (11/3). During the trial, SPM, the victim's mother, testified virtually regarding the incident that befell her son.

According to him, the presence of the victim's family in the judicial process is an important part so that the victim's voice can still be heard by the panel of judges. The assistance is also aimed at helping the victim's family understand their rights during the legal process.

The fulfillment of the victim's rights refers to Law Number 31 of 2014 in conjunction with Law Number 13 of 2006 concerning Witness and Victim Protection, and is regulated in the new Criminal Procedure Code through Law Number 20 of 2025.

In addition, the right to restitution for victims is also regulated in Government Regulation Number 7 of 2018 concerning the Provision of Compensation, Restitution, and Assistance to Witnesses and Victims.

LPSK considers restitution to be an important part of recovery for victims and families affected by criminal acts. This mechanism is also a form of state recognition of the losses suffered by victims and confirms the responsibility of the perpetrators.

Support for the assistance carried out by LPSK was also conveyed by Deputy Chairman of Commission XIII of the DPR RI Andreas Hugo Pareira. He assessed that the presence of LPSK in the judicial process provided important support for the victims' families in fighting for justice.

Andreas also emphasized the need to strengthen the institutional capacity of the LPSK so that protection for witnesses and victims can be more optimal.

"The strengthening includes human resources, budget support, to infrastructure, including expanding the presence of LPSK in the region so that cases can be handled faster," he said.

He also encouraged increased synergy between the LPSK and local governments as well as relevant ministries and agencies to ensure that the implementation of witness and victim protection is more effective.

In the appeal process, the victim's family also expressed the hope that the additional penalty in the form of dismissal from the military service against the defendants would be maintained by the panel of judges.

Previously, in the first-instance ruling, the panel of judges stated that 22 defendants were legally proven to have abused Prada Lucky, causing the victim to die. The defendants were sentenced to prison terms ranging from six to nine years and additional penalties in the form of dismissal from military service.

In addition, the panel of judges also ordered the defendants to pay restitution to the victim's family. Based on the LPSK calculation, the total restitution imposed on the defendants amounted to around IDR 1.6 billion with different amounts according to the level of involvement of each perpetrator.

Antonius emphasized that his party would continue to monitor the development of the case until the final and binding decision, including ensuring the implementation of the obligation to provide restitution to the victims' families.
