Member of Commission IX of the House of Representatives Asep Romy Romaya asked the government to take firm action against companies that violate the obligation to pay the Eid Bonus (THR) to employees.

Asep assessed that the violations that continue to occur every year show the weakness of supervision and enforcement of laws on workers' rights.

"We ask the government to give strict sanctions to companies that violate the obligation to pay THR. Don't let this become a pattern that repeats year after year without any deterrent effect," Asep Romy told reporters, Wednesday, February 25.

Romy said, every time before religious holidays, the issue of THR always resurfaces with a pattern that is almost similar. According to him, the voices of workers who are harmed seem to be "an old cassette that keeps spinning", namely the same complaints, the same demands, but without a complete settlement.

"This condition must not be allowed to continue. The state must be present in a tangible way, not just responsive when polemics emerge in the public space," he added.

Romy also revealed that there were various methods that companies often used to avoid paying THR, ranging from laying off workers to breaking contracts before Lebaran. These practices, he said, should be suspected as a systematic effort to avoid legal responsibility.

"These kinds of ways are almost certain to happen every year. This must be stopped. All companies are required to pay THR in accordance with applicable regulations. There should be no tricks that harm workers," he said.

Romy explained that as regulated in the Minister of Manpower Regulation Number 6 of 2016 concerning Religious THR for Workers / Workers in Companies, THR must be paid no later than H-7 before the religious holiday. Companies that violate it can be subject to administrative sanctions ranging from written reprimands, restrictions on business activities, temporary suspension of some or all production equipment, to the freezing of business activities.

"If violations continue to occur year after year, it means that something is not going well in our supervision system. The government must ensure that workers' rights are protected, and that companies that violate it really feel the consequences," concluded Romy.
