JAKARTA - The DPR RI Agrarian Conflict Resolution Commission highlighted the agrarian conflict in the Nghalae-Sikka customary area, East Nusa Tenggara (NTT). The DPR urged the police to not prosecute parties who are resolving agrarian issues.
Member of the DPR RI Agrarian Conflict Resolution Committee, Muhammad Khozin reminded law enforcement officials to be careful in using criminal articles in agrarian cases that are ongoing in the community.
"Law enforcement agencies should be able to capture the spirit of the President in resolving agrarian conflicts. Be careful in prosecuting citizens related to agrarian issues," said Khozin at the Senayan Parliament Complex, Jakarta, Monday, February 9.
Khozin emphasized that in the case that occurred in the customary area in Naghalae-Sikka, NTT on an area of 868.73 hectares inhabited by around 1,237 residents was used as a settlement and agricultural land that had been owned by the community since 1860.
"Presidential Decree 32/1979 stipulates that land of ex-HGU occupied by the people and suitable for settlement/agriculture must be given to the people," he said.
Meanwhile, the process of reclaiming the land by residents, continued Khozin, has been going on since 1996-2000, and residents have experienced criminalization in 2000 and 2014. At the same time, he said, mediation efforts were deadlocked.
"In 1989-2013 the government issued HGU to PT DIAG. In 2017 the HGU land was included in the Terindikasi Registration of Abandoned which resulted in the HGU application being stopped," said Khozin.
However, he added, in 2023 the new HGU was issued again which was intended for PT Krisrama which ultimately triggered the eviction of residents in early 2025.
"Problems like this should be avoided by adhering to the applicable legal rules, and the spirit of seeking common solutions, not strong solutions by using criminalization and eviction of residents," explained Khozin.
Therefore, the PKB legislator urged that the problem of agrarian conflict, especially in customary land, should be given priority to persuasive ways, and returned to the applicable legal mechanisms.
"The local government, Kantah ATR/BPN, and the police can lower the tension by making the object of dispute a status quo while encouraging a comprehensive and holistic settlement. There is no criminalization and eviction!," said Khozin.
