BANDA ACEH - Seven defendants in the corruption case of the procurement of hand washing or sink and sanitation facilities for schools during the COVID-19 pandemic in Aceh Province were charged with causing damage to state finances of more than IDR 2.97 billion.

The indictment was read by Public Prosecutor (JPU) Putra Masduruli and his colleagues from the Banda Aceh District Attorney's Office during the trial at the Corruption Crime Court at the Banda Aceh District Court in Banda Aceh, Monday, February 2.

The trial with a panel of judges was chaired by M Jamil and was accompanied by R Deddy Haryanto and Anda Ariansyah.

As reported by ANTARA, the defendants are Syifak Muhammad Yus, Abdul Hanif, Muslim Ibrahim, Mursalin, Herlin, and Wiki Noviandi and Iqbal. The defendants attended the trial accompanied by their respective legal counsel teams.

The prosecutor in his indictment stated that the procurement of sinks and sanitation was managed by the Aceh Provincial Education Office in the 2020 Fiscal Year. The procurement budget was sourced from the COVID-19 refocusing of more than IDR 45 billion.

The procurement of sinks is intended for 401 SMA, SMK, and extraordinary schools (SLB) under the auspices of the Aceh Provincial Education Office. The schools are spread across 23 districts and cities in Aceh Province. In the process, the procurement is divided into 390 work packages

The defendants are implementing partners who nominate officials from the Aceh Provincial Education Office. However, in the implementation of procurement work, some were carried out not in accordance with the specifications so that there was a lack of volume and some were not carried out.

Based on the results of the audit of the Aceh Representative of the Financial and Development Supervisory Agency (BPKP), the state losses incurred in the corruption case of the procurement of sinks and sanitation amounted to IDR 2.97 billion.

The JPU charged the defendants subsidiarily, namely primairsebagaimana threatened with criminal penalties in Article 603 of Law Number 1 of 2023 concerning the Criminal Code jo Article 18 of Law 31 of 1999 as amended into Law Number 20 of 2001 concerning eradication of corruption crimes jo Article 20 letter a, c of Law Number 1 of 2023.

As well as subsidies as threatened by the criminal act in Article 3 Paragraph (1) Jo Article 18 of Law 31 of 1999 as amended into Law Number 20 of 2001 concerning the eradication of corruption as amended by Law Number 1 of 2023 concerning the Criminal Code jo Article 18 of Law 31 of 1999 as amended into Law Number 20 of 2001 jo Article 20 letter a, c Law Number 1 of 2023.

Regarding the charges, five defendants, including one, stated that they did not object to the JPU's charges. The five defendants through their legal counsel team asked for the trial to continue at the trial.

Meanwhile, the other two defendants, namely Wiki Noviandi and Iqbal through their legal advisors stated that they had filed an objection or objection to the public prosecutor's indictment.

The panel of judges continued the trial next week with the agenda of listening to the defendant's objections and legal advisers.

Junaidi, the defendant's legal advisor Wiki Noviandi, expressed objections to the prosecutor's indictment. Because Wiki Noviandi never signed any documents related to the procurement of sinks, both contract documents and budget search documents.

"We respect the charges presented by the public prosecutor in the trial. However, our client has never committed any illegal acts in this case," said Junaidi after the trial.

According to him, his client is only a borrower of money to another party in the implementation of the procurement of sinks. So, Wiki Noviandi should not be made a defendant under the pretext of having committed his act against the law.

"We as Wiki Noviandi's legal counsel express our objection and reject all the public prosecutor's charges. We are filing a challenge against the public prosecutor's charges presented at the next trial," said Junaidi.
