JAKARTA - The Constitutional Court (MK) has received nine applications for a test of the controversial articles in the new Criminal Code (KUHP) which has been in force since January 2, 2026 and is ready to hear the case. Two of them have entered the preliminary hearing last weekend.

Of the nine lawsuits, none questioned the legislative process or the entire article in the new Criminal Code. Each lawsuit questioned a number of controversial articles that are often considered as rubber articles.

Among them, Article 433 of the Criminal Code concerning defamation, Article 240 concerning insults to state institutions, Article 411 concerning gatherings, and Article 218 concerning the president and vice president.

Head of the MK's Public Relations and Protocol Bureau, Pan Mohamad Faiz, revealed that the nine lawsuits had been registered on the MK's website and were waiting for their turn for the preliminary hearing process.

"For the substance or substance being tested, the application has been registered for testing the Criminal Code," Faiz said in his statement, Monday, January 12.

Faiz said the preliminary trial process was the earliest stage before the arguments of each plaintiff and defendant were pitted against each other.

When contacted separately, a member of Commission III of the DPR from the Democratic Party, Hinca Panjaitan, respected the lawsuit filed by a number of parties.
