JAKARTA - The parent of the Market Traders Cooperative (INKOPPAS) has asked that the Draft Regional Regulation on Tobacco-Free Areas (Raperda KTR) of DKI Jakarta no longer contain a ban on the sale of cigarettes within a radius of 200 meters from educational units and children's playgrounds, as well as a ban on smoking products at the point of sale.

This request was conveyed following the discussion of the KTR Regional Regulation in the plenary session of the DKI Jakarta DPRD on Tuesday, December 23 last week.

INKOPPAS Secretary General Andrian Lamemuhar assessed that the two provisions have the potential to have a direct impact on the income of market traders and small traders.

According to him, the ban will actually narrow the business space for traders who have been relying on cigarette sales as one of the commodities.

"Don't let the KTR regulation that was passed become a ridiculous regulation. If there is still a ban on sales and a ban on layoffs, it is the same as burdening and reducing the income of market traders, as well as kolontong traders. The effects of these prohibitions will be felt directly on the traders' economy because it will definitely reduce income," Andrian told reporters, Monday, December 29.

INKOPPAS also highlighted the potential for increased circulation of illegal cigarettes if the ban on layoffs is maintained. According to Andrian, this restriction actually opens up a space for transactions that are not transparent at the consumer and trader levels.

"If this ban on smoking is still imposed in the KTR Regulation, the state will be harmed because illegal cigarettes will eventually not have to be sold anymore in secret. The effect is more dangerous," said Andrian.

The KTR DKI Jakarta Regional Regulation itself has gone through the facilitation process by the Directorate General of Regional Autonomy of the Ministry of Home Affairs (Ditjen Otda Kemendagri). The results of the facilitation are open and contain a number of directions that need to be considered by the local government.

Andrian hopes that the DKI Jakarta Provincial Government and the DKI Jakarta DPRD will seriously consider the results of the facilitation. He emphasized the importance of regulations that are not only oriented towards regulation, but also take into account the sustainability of the market traders' economy.

"Once again, don't let a KTR regulation be born that makes it difficult for market traders. If the traders' income is less, we can't pay the levy and the family's livelihood is not fulfilled," he said.
