Residents Are Worried, Debt Case 1983 Drags Land 3 Villages In Bogor To BLBI Auction Process

The problem of hundreds of hectares of land in 3 villages in Bogor Regency, West Java, which is now in danger of being auctioned off, has been rooted since 1983. At that time, Lee Chin Kiat alias Lee Darmawan Kertarahardja Haryanto, Director of Bank Pembangan Asia, gave a loan to Haji Madrawi.

At that time, Haji Madrawi served as Director of PT Perkebunan and Livestock National Gunung Batu. Land in Sukawangi, Sukaharja and Sukamulya Villages, Sukamakmur District, was then used as debt guarantee. Later, this asset was dragged into the case of Bank Indonesia liquidity assistance (BLBI) until it finally entered the auction process.

In the decision to appeal the civil case Number 805 / PDT / 2022 / PT DKI, it was revealed that the companies in control of the land were PT Livestock and Mount Batu Makmur Plantation with the management of Sutikno Wijoyo (main commissioner), Djaenal Abidin (commissioner), and H Madrawi (main director). H Madrawi was later discovered to be a subordinate and close to Lee Chin Kiat.

However, the deed of establishment of PT was made before notary H Saedrus was never registered with the Ministry of Justice, so it was not legal as a legal entity. Then, on January 29, 2020, the plaintiff established a new PT with the same name as PT Perkebunan and Animal Husbandry Nasional Gunung Batu Makmur which had obtained approval from the Ministry of Law and Human Rights.

In the petitum of his lawsuit, the plaintiff asked the court to declare the old PT illegal legally and cancel the village land auction which was used as debt guarantee. The panel of judges in their decision confirmed that the old company was different from the new PT, both in terms of management and finance.

This case made thousands of residents in Sukaharja Village and Sukamulya Village restless. They are worried that the loss of land rights they have occupied has passed down from generation to generation due to the transfer of problematic assets starting from debt transactions that have been in debt since four decades ago.
