Bill On Asset Confiscation, Expectations To Impoverish Corruptors Or Instead Create New Problems?

JAKARTA Unpad criminal law expert, Romli Atmasasmita, said that there are legal and social consequences that must be considered in terms of implementation if the Asset Confiscation Bill has been passed.

He revealed that the Asset Confiscation Bill has attracted the attention of the public who hopes that the Asset Confiscation Bill can impoverish corruptors and stolen state money can be saved optimally.

"The hope and goals of the community are feasible and reasonable. However, behind these hopes and goals, there is a potential for irregularities that actually harm the state even more," Romli said in a written statement, Sunday, September 14, 2025.

He explained, there is a role model, namely law as a tool of the powerful against the powerless', which means that the law becomes a tool of power to oppress the weak. This will lead to possible legal consequences, in which the Asset Confiscation Bill can result in corruption perpetrators being impoverished but it can also not be the opposite, and even still escapes punishment.

Not to mention, in a state of social reaction to the problem of corruption and the strong will of the community to impoverish the perpetrators of corruption. Therefore, the implementation of the Asset Confiscation Law in the future must be prevented and overcome, especially the possibility of leakage in its management.

"Which has become a bad habit for law officials so far who have not recovered from the reactions and cynicism of society so far," added Romli.

According to him, such legal and social issues are challenges and studies of the government, which programs will be prioritized first, legal issues or social problems. It is certain that this question is homework not only for the government, law enforcement institutions only, but also for the community of KKN observers who must be rational and objective in giving an assessment of the implementation of the Asset Confiscation Law in the future, "said Romli.
