Coordinating Minister Yusril Values Discussing The Asset Confiscation Bill And The Criminal Procedure Code Can Simultaneously

Coordinating Minister for Law, Human Rights, Immigration and Corrections (Menko Kumham Imipas) Yusril Ihza Mahendra assessed that the discussion of the Draft Law (RUU) on Asset Confiscation and the Criminal Procedure Code (KUHAP) could be carried out simultaneously.

Because, he said, the Criminal Procedure Code Bill contained a general criminal procedural law, while the Asset Confiscation Bill contained a special criminal procedural law, so the discussion had to be synchronized.

"So, it's not allowed for this special to hit the general public. Because it must be discussed, maybe it can be discussed simultaneously," said Yusril when giving a statement at the Makassar Police Headquarters, South Sulawesi, Thursday (11/9), as confirmed in Jakarta, Friday, confiscated by Antara.

He also asked all parties to believe that the government and the House of Representatives (DPR) have a commitment to discuss the Asset Confiscation Bill in the not too distant future.

Yusril said that based on the report of the Minister of Law Supratman Andi Agtas, the Asset Confiscation Bill was included in the 2025-2026 Priority National Legislation Program (Prolegnas).

He explained that the draft Asset Confiscation Bill had been completed since it was initiated by the administration of the 7th President of the Republic of Indonesia Joko Widodo, which was followed by a presidential letter (supres) appointing the former Minister of Politics, Law and Security (Menko Polhukam) Mahfud Md and former Minister of Law and Human Rights (Menkumham) Yasonna Laoly as government representatives to discuss the bill.

However, due to the change of government, said the Coordinating Minister, the draft bill proposed by the government was postponed for discussion with the DPR to ensure that the manuscript would still be used or withdrawn by the new government and the DPR.

"Talks in the DPR now tend towards that the DPR will submit a new Asset Confiscation Bill," he said.

Nevertheless, he said there was a possibility that the DPR would submit a draft of the Asset Confiscation Bill and discuss it after the discussion of the Criminal Procedure Code Bill was completed.

The discussion of the Criminal Procedure Code is targeted to be completed by the end of 2025 so as not to hinder the implementation of the new Criminal Code (KUHP) which will be implemented on January 2, 2026.

Similarly, previously Member of Commission III DPR RI Nasir Djamil argued that the Criminal Procedure Code Bill and the Asset Confiscation Bill could be discussed in parallel at Commission III of the DPR.

He said his party was ready to discuss the Asset Confiscation Bill if later submitted by the Legislation Body of the DPR RI. Currently, the Legislation Body of the DPR has proposed to include the Asset Confiscation Bill in the 2025 priority list.

"It's technical. It can be parallel or what comes first, which one needs to be resolved," Nasir said at the parliament complex, Jakarta, Wednesday.

According to him, the proposal for the Asset Confiscation Bill is like a tit for his party. Because, he said, there were various opinions to discuss the bill.

Even so, he said that he would first focus on the vision expected by President Prabowo Subianto on the Asset Confiscation Bill.
