PALEMBANG - Defendant Kopda Basyarsyah filed an appeal against the death penalty handed down by the panel of judges at the Palembang I-04 Court in connection with the shooting of three police officers at the cockfighting gambling location in Way Kanan Regency, Lampung
The panel of judges at the Palembang Military Court I-04 previously sentenced Kopda Bazarsah to death, as well as dismissal from military service.
The inkrah or appeal decision will be decided on Tuesday, August 19, 2025. If the appeal is accepted, said the panel of judges, it will be returned to the Medan Military High Court I.
Kopda Basyarsyah through his attorney will file an appeal against the verdict.
"We have seen this decision, we are a team of attorneys and the defendant will appeal as it is the right of the defendant," said Kopda Basyarsyah's attorney, Colonel CHK Amir Welong after the trial at the Palembang Military Court I-04, Monday, August 11, as reported by ANTARA.
He explained that his party agreed with the statement of the panel of judges who saw this case not as planned as regulated in Article 340 of the Criminal Code.
However, he saw Articles layered with 338 of the Criminal Code paragraph 1 of the 1st, Emergency Law Number 12 of 1951 concerning Illegal Ownership of Firearms and Sharp Weapons, as well as Article 303 of the Criminal Code concerning gambling crimes with a maximum death penalty considered too heavy for the defendant.
"This defendant also has a family, the defendant is also an ordinary human being who does not escape mistakes. Maybe previously the defendant did not plan something like that (murder). Article 340 is not proven, meaning spontaneity and self-defense," he explained.
His party also apologized to the families of the victims who died in their duties in Manik State, Way Kanan, Lampung, because the actions of the defendant Kopda Bazarsah still violated the rule of law and were guilty before the law.
"We also express our condolences for the death of our colleague from the Police," said Amir.
Previously, the Military Court I-04 Palembang, South Sumatra, sentenced the defendant Corporal Two Bazarsah to death in the shooting case of three policemen at the cockfighting gambling location, Way Kanan Regency, Lampung.
