Sany Group Fine Of IDR 449 Billion, KPPU: Largest After Google

JAKARTA - The Business Competition Supervisory Commission (KPPU) has imposed a fine of Rp449 billion against three Sany Group companies. This sanction was given because it was proven to have cheated by monopolizing the sale of Sany trucks in Indonesia.

Head of the Public Relations and Cooperation Bureau of KPPU Deswin Nur conveyed that the amount of fines contained in Case Number 18/KPPU-L/2024 concerning Allegations of Violations related to Sany Brand Truck Sales was the largest in history. They imposed a fine on Google of IDR 202.5 billion on January 21, 2025.

"Decisions and fines are the largest fines in the history of law enforcement of business competition, after Google," Deswin said in a press statement quoted Monday, August 11.

The Sany Group has proven to have violated vertical integration and controlled the truck market in Indonesia. As a result, it does not create national economic efficiency.

In addition, the business environment is also affected. "This should be a lesson for all business actors, whether foreign or domestic investment, that KPPU does not play games in imposing sanctions on business actors who practice monopolies and unfair business competition," he said.

The decision on the fine was read out at the Assembly Session of the Commission chaired by Moh. Noor Rofieq as Chairman of the Assembly, as well as M. Fanshurullah Asa and Rhido Jusmadi respectively as Members of the Assembly. The trial was held on Tuesday, August 5.

This case initially came from public reports regarding Allegations of Violations of Article 14 of Law Number 5 of 1999 relating to vertical integration and Article 19 Letter a, b, c, and d related to market control in the sale of Sany brand trucks and their spare parts in Indonesia.

The cases involved 4 (four) Reported, namely Sany International Development, Ltd. (Reported I), PT Sany Indonesia Machinery (Terlapor II), PT Sany Heavy Industry Indonesia (Terlapor III), and PT Sany Indonesia Heavy Equipment (Terlapor IV).

Reported I, who is responsible for the international operation of its parent company, namely Sany Heavy Industry Co Ltd, appointed a non-exclusive dealer, namely PT Pusaka Bumi Transport and PT Gajah Utama Internasional.

Although the two companies are dealers, the purchase of Sany trucks and spare parts is carried out through Reported II and Reported III.

This condition causes dealers to be treated discriminatoryly by Reported I. The reason is, dealers are required to buy Sany truck products from their competitors with a changing payment system.

With a short payment system with a sales target set by Terlapor I causing dealers to have difficulty in payment, and finally out of the market.

Dari fakta-fakta tersebut, Majelis Komisi dalam keputusannya menyebutkan;

Reported I, Reported II, Reported III, And Reported IV were legally and convincingly proven to have violated Article 14 of Law Number 5 of 1999;

Reported I, Reported II, And Reported III were legally and convincingly proven to have violated Articles 19 letters a and b of Law Number 5 of 1999.

Reported I, Reported II, Reported III, And Reported IV were legally and convincingly proven to have violated Article 19 letter d of Law Number 5 of 1999.

Reported I, Reported II, Reported III, And Reported IV were not proven to have violated Article 19 letter c of Law Number 5 of 1999;

Reported IV was not proven to have violated Articles 19 letters a and b of Law Number 5 of 1999;

In addition, the panel also imposed a fine on Reported Party II of Rp. 360,000,000,000, Reported III of Rp. 57,000,000,000; and Reported IV of Rp. 32,000,000,000. Hundreds of billions will have to be deposited into the State Treasury as a deposit of revenue for fines for violations in the field of business competition for the KPPU Work Unit through the Government bank with the receipt code 425812 (Income of Fines for Violations in the Business Competition Sector).
