JAKARTA - A number of residents of the Marinatama Mangga Dua Complex, North Jakarta and their attorneys filed a lawsuit against the North Jakarta BPN Office to the Jakarta Administrative Court, Tuesday, July 29, 2025.

"The trial was only limited, only judicial checks, legal standing, ID cards of the parties and legal entities. For technical problems regarding procedures, I think it can be further improved," said Subali, 42 residents' attorney, told reporters after the trial.

Subali said the agenda for this trial for the defendant was the Head of the North Jakarta City Administration Land Office.

Residents complained that for 25 years the right to use buildings (HGB) had not been issued by the local National Land Agency (BPN).

However, on its way to now, it turns out that the object of HGB land was promised that on behalf of the residents of the shophouse, a certificate of use on behalf of a ministry should have been issued.

So that as many as 42 residents finally filed a lawsuit with the Jakarta Administrative Court.

The coordinator of the MSD community, Wisnu Hadi Kusuma, said that in principle many residents for 25 years were waiting for the HGB certificates that would not come out.

For the first time, with good faith, residents bought the shophouse from a developer with a sale and purchase agreement. Because at that time the HGB certificate was promised by the developer to be processed.

"So at that time the sale and purchase was only used a sale and purchase agreement," he said.

Wisnu said that after one year had passed, a number of shop residents asked for their promise to the developer. However, the reason is that the HGB certificate is in process.

In fact, he continued, at that time it was not a promising developer anymore, but a cooperative that collaborated with the developer, promising the HGB certificate to the residents.

"The reason is that it is always in the process, there should be proof of the process, usually in BPN there is a receipt. We ask the cooperative as a certificate issued stating that (the HGB certificate) is in process. But the process number is not there. But it has been promised," he regretted.

In addition to this, continued Wisnu, a number of residents filed their demands in accordance with the initial agreement, the sale and purchase agreement, promised by the HGB certificate.

"Our hope is that justice and law are enforced. So the important thing is that the law must be enforced. Do not let this society be persecuted by officials, by the state. That's all we hope for," he said.

Meanwhile, until this news was written, the Jakut BPN Office had not provided an official statement regarding the lawsuit.
