K3 Licensing Corruption Case, Former Head Of South Sumatra Manpower And Transmigration Office Sentenced To Lighter Than Prosecutors' Demands

PALEMBANG Former Head of the South Sumatra Province Manpower and Transmigration Service (Kadisnakertrans), Deliar Marzoeki, was sentenced to five years in prison and a fine of Rp250 million, subsidiary to six months in prison by the Palembang Special Class IA District Court, Wednesday, July 16.

As reported by ANTARA, Thursday, July 17, Deliar was judged to have been legally and convincingly proven to have violated Article 11 of the Corruption Act, which regulates the receipt of gifts or promises made by state officials regarding his position. The verdict was read out by the Chairman of the Panel of Judges Idi'il Amin.

In addition to the main sentence, Deliar was also sentenced to additional punishment in the form of the obligation to pay compensation of Rp1,343 billion. If not paid, his property will be confiscated, and if it is not sufficient, it will be replaced with imprisonment for three years.

This verdict is lighter than the demands of the Public Prosecutor from the Palembang District Attorney, Syahran, who demanded eight years imprisonment, a fine of Rp. 500 million, a subsidiary of six months in prison, and compensation of Rp. 1.3 billion or a sentence of four years in prison if not paid.

Based on this decision, both the defendant through his legal advisers, Nurmala and the team, as well as the public prosecutor expressed their thoughts.

"You have seven days to think about whether to appeal or accept this decision," said the Chief Justice before closing the trial.

This case stems from the Hand Catching Operation (OTT) carried out by the Palembang District Attorney's Special Criminal Team. In the OTT, Deliar Marzoeki and his personal staff, Alex Rahman, were arrested for allegedly accepting bribes related to the issuance of a Work Safety and Health Permit (K3).

From the results of the search, investigators found evidence in the form of foreign denominations, 117 envelopes containing Rp1 million each, a number of fake number plates, precious metals, and other assets.

Meanwhile, Alex Rahman was sentenced by the panel of judges to one year in prison and a fine of IDR 50 million.
