Accelerate The Legal Basis For Moving Prisoners Between Countries, Kumham Imipas Speeds TSP Bill

JAKARTA - The government continues to encourage the acceleration of the preparation of the Draft Law on Prisoner Transfers and Correctional Subjects (RUU TSP) as part of strategic steps to strengthen the legal basis for the transfer of prisoners between countries.

Secretary of the Coordinating Ministry for Law, Human Rights, Immigration and Corrections (Kemenko Kumham Imipas) Andika Dwi Prasetya revealed that the preparation of the TSP Bill had actually started in 2017, but due to various dynamics, the process was delayed and has now resumed on President Prabowo's orders.

"The TSP Bill has actually been very long, its initiator from the Ministry of Law and Human Rights in 2017 has been harmonized, but because of the issue of pending draft, it was returned. The bill was rearranged on the orders of the President because it was deemed important to make," Andika said in a coordination meeting in Jakarta (4/7), as confirmed in Jakarta, Tuesday, was confiscated by Antara.

The coordination meeting between ministries/agencies (k/l) was held intensively 2 times a week to ensure that the substance of the TSP Bill could be finalized immediately.

The hope is that the meeting held can unite the differences of opinion from the k/l so that they find the best TSP Bill

Andika said that in the meeting between k/l on April 17, 2025, it was agreed that the Coordinating Ministry for Kumham Imipas would be the initiator of the TSP Bill.

Meanwhile, Deputy for Legal Coordination of the Coordinating Ministry for Human Rights, Kumham Imipas Nofli, added that the acceleration effort had entered the harmonization stage. In the future, a ministerial level meeting will be held to clarify the division of the roles of each party.

"There will be a ministerial level meeting on the division of roles. It can be everyone's thinking, so that each role will be presented by the Coordinating Minister to contribute," said Nofli.

Assistant Deputy for Coordination for the Establishment of Legislation and Litigation Regulations at the Coordinating Ministry for Human Rights, Imipas Fiqi Nana Kania, emphasized that the formation of the TSP Bill is a mandate from the Correctional Law and has been included in the medium-term national legislation program (prolegnas).

The drafting of the script will use academic documents compiled by the National Legal Development Agency (BPHN) in 2024.

"There are adjustments from the 2017 draft, from title to content, and there needs to be adjustments to international law," said Fiqi.

He explained that the TSP Bill will regulate the supervision of transferred prisoners, both abroad and domestically, with a request scheme from related countries or from prisoners' families.

The meeting was also attended by the Special Staff of the Coordinating Minister for Kumham Imipas for Strategic Issues Karjono who was present in person. Meanwhile, the Expert Staff of the Coordinating Minister for Kumham Imipas for Cooperation and Inter-Institutional Relations Cahyani attended an online meeting from a separate location.

The involvement of cross-sector stakeholders shows the Government's commitment to draft comprehensive and applicative regulations.

The TSP Bill is expected to become a strong legal framework to support international cooperation in the correctional sector, as well as guarantee the rights of prisoners involved in the cross-border transfer process.
