This time, one of the shareholders of PT BRW, Didi Dawis, filed a civil lawsuit against Sigit Harjojudanto, the second son of President Suharto. "This report is related to the alleged unlawful act committed by Sigit Harjojudanto against our client, Mr. Didi Dawis," said Didi Dawis' attorney, Chandra Kurniawan, to reporters after registering a lawsuit at the Central Jakarta District Court.
Chandra explained that this lawsuit was filed regarding the claim that Sigit stated that he had rights to PT BRW shares based on the Share Binding Agreement which was made with one of the shareholders of PT BRW, Saiman Ernawan, in 2015.
In the agreement, Sigit claimed to have handed over Rp50 billion in funds to Saiman to buy 50 thousand shares or the equivalent of 25% of PT BRW's shares. At that time, Saiman served as President Director of PT BRW. On July 8, 2024, Sigit's attorney, Moch. Nafis Al Thaf Raffan, reported Saiman to Polda Metro Jaya. Chandra said that the relationship between his client and Sigit was previously very good and had been going on for a long time. However, the emergence of the report prompted the need for legal proof of the Stock Binding Agreement made when Saiman was still in office.
"Can someone who doesn't have a stock certificate be said to be a shareholder? We see this as a nominee practice, which is clearly prohibited by law. Therefore, we want to test it in court," he stressed.
Chandra added, if Didi Dawis' lawsuit is not granted, his party asks Sigit to also take responsibility for the debts that involve PT BRW, not only demanding profits as shareholders.
Currently, PT BRW is facing a trial requesting the cancellation of peace (homologation) in the process of Postponing Debt Payment Obligations (PKPU) submitted by six applicants at the Commercial Court at the Central Jakarta District Court.
