Administrative Court Wins PLK, SMAN 1 Bandung Is Threatened With Land Loss

BANDUNG - Bandung State Administrative Court (PTUN) won the Christian Lyceum Association in a dispute over the land status case of SMA Negeri (SMAN) 1 Bandung.

In the decision of the Bandung Administrative Court with Case Number 164/G/2024/PTUN.BDG dated April 17, 2025, the court decided to grant the lawsuit from the Christian Lycheum Association, and rejected the defendant's exception (Head of the Land Office/BPN Bandung City) and the intervention defendant (Head of the West Java Provincial Education Office).

"The trial, in the exception, stated that the exception of the Defendant and Defendant II Intervention was not fully accepted. In the subject of the dispute, it granted the plaintiff's claim in its entirety," wrote the decision of the Bandung Administrative Court seen by ANTARA in Bandung, Friday, April 18.

The points of two verdicts in the subject of the dispute, the Administrative Court declared null and void with the Certificate of Rights Number: 11/Kel. Lebak Siliwangi, published on August 19, 1999, Letter of Law on 12-4-1 999 No. 12/Lebak Siliwangi/1999, covering an area of 8,450 M2, on behalf of the Department of Education and Culture, Cq. West Java Provincial Office.

The third point, the court requires the Defendant to revoke the Certificate of Use Rights Number: 11/Kel. Lebak Siliwangi, published August 19, 1999, Letter of Law on 12-4-1999 No.12/Lebak Siliwangi/1999, covering an area of 8,450 M2, on behalf of the Department of Education and Culture, Cq. West Java Provincial Office.

The fourth point, the court requires the Defendant to process the extension and issue a Building Use Rights certificate in the name of the Plaintiff, as contained in the Building Use Rights Certificate Number: 1228/Kel. Lebak Siliwangi, Building Use Rights Certificate Number 12 29/Kel. Lebak Siliwangi, and Building Use Rights Certificate Number 1232/Kel. Lebak Siliwangi.

The fifth point of the verdict, the court sentenced the Defendant and Defendant II to pay court fees in the amount of Rp. 40,000.

Until this news was completed, related parties such as SMAN 1 Bandung, Bandung City BPN Office, West Java Provincial Education Office, West Java Province Legal and Human Rights Bureau had not yet responded to this decision.

Previously, the West Java Provincial Government (Pemprov) had prepared a legal team to accompany the Bandung State Senior High School (SMAN) 1 which was being sued by the Christian Lycheum Association regarding the land used by the school.

"We have prepared SMA 1 Bandung for the legal team to assist," said West Java Governor Dedi Mulyadi at Husein Sastranegara Air Base Bandung, Tuesday (11/3).

PLK registered its lawsuit with number 164/G/2024/PTUN.BDG since November 4, 2024. PLK sued the Head of the Bandung City Land Office as the first defendant, as well as the intervention of the West Java (West Java) Education Office.
