Defected Procedures And Materials, Minister Of ATR Cancels SHGB Status Of Sea Pagar In Tangerang

JAKARTA - Minister of Agrarian and Spatial Planning (ATR)/Head of the National Land Agency (BPN) Nusron Wahid said that the issuance of the Building Use Right Certificate (SHGB) and the Sea fence Ownership Certificate (SHM) in the northern coastal area (Pantura), Tangerang Regency, Banten, had the status of a defective procedure and material, therefore it was null and void by law.

"From the results of a review and inspection of the boundaries outside the coastline, it should not be private property, then this cannot be certified, and we view that the certificate outside is a defective procedure and material defect," Nusron explained at a press conference in Tangerang, Antara, Wednesday, January 22.

According to him, based on the results of verification and review of the land/shoreline boundaries previously contained in the Building Use Rights Certificate (SHGB) and Ownership Certificate (SHM) on the north coast of Tangerang Regency, the status was automatically revoked and canceled.

"Based on PP Number 15 of 2021 as long as the certificate is not five years old, the Ministry of ATR/BPN has the right to revoke it or cancel it without a court order process," he said.

He explained that of the 266 SHGB and SHM certificates that were under the sea and matched with existing map data, it was known to be outside the coastline.

Therefore, his party is currently calling and examining the measuring officers and officers who signed or ratified the status of the certificate as a applicable law enforcement measure.

"Today we have been summoned to the officer by the government's internal supervisory apparatus regarding the examination of the code of ethics," he said.

Previously, Nusron admitted that he had ordered the Director General (Dirjen) of Land and Spatial Planning (SPPR) of the Ministry of ATR/BPN Virgo Eresta Jaya to also summon the Licensed Surveyor Service Office (KJSB).

The Minister of ATR stated that the summons was because KJSB was involved in land measurements before the issuance of the Building Use Rights (HGB) certificate related to the sea fence project, namely a survey service office originating from the private sector.

The Ministry of ATR/BPN will ensure whether the applicable procedures have been followed and carried out properly in the measurement process by the KJSB or not

The Ministry of ATR/BPN has also conducted an initial search that 263 fields of SHGB have been published in this location, consisting of 234 SHGB fields in the name of PT Intan Agung Makmur, 20 fields of SHGB in the name of PT Cahaya Inti Sentosa, and 9 fields in the name of individuals.

In addition, 17 parcels of ownership certificates (SHM) were also found in the area.

The Ministry of ATR/BPN emphasized that if the results of the coordination of the checking that had been issued were proven to be off the coastline, evaluation and review would be carried out.
