This Is The Full Story Of The President Director Of Tigapilar Ardian Iskandar, Juliari Batubara's Bribe Of Rp1.95 Billion

JAKARTA - President Director of PT Tigapilar Argo Utama, Ardian Iskandar Maddanatja, who was a bribe for former Social Minister Juliari Peter Batubara, is charged with making bribes related to the provision of social assistance (bansos) worth Rp1.95 billion.

The bribes were given in stages, precisely when the social assistance project entered its second period.

"Has committed several actions that have such a relationship that it must be seen as a continuing act, giving something, namely giving a total of Rp1,950,000,000 to civil servants or state officials," said prosecutor Muhammad Nur Azis reading out the dakwan during the trial at the Corruption Court, Jakarta, Wednesday, February 24.

In the indictment, the criminal act of bribery began when Ardian met his colleague Helmi Rivai at Wisma MRA, Cilandak, South Jakarta. The meeting was to ask about the provision of basic food assistance in handling the impact of Corona Virus Disease 2019 (COVID-19) at the Ministry of Social Affairs (Kemensos).

During the meeting, Helmi said that he would introduce Ardian to a person named Nuzulia Hamzah Nasution. He is said to be able to help Ardian get his company on the social assistance procurement project.

The confidence to get the project is because Helmi and Nuzulia have been introduced by Isro Budi Nauli to Pepen Nazaruddin as Director General of Social Security Protection of the Ministry of Social Affairs.

"Next Pepen asked Nuzulia and Helmi to meet with Adi Wahyono and Matheus Joko Santoso at the Ministry of Social Affairs office by bringing the company profile of PT Tigapilar Argo Utama," said the prosecutor.

Originally, Adi and Matheus were the Ministry of Social Affairs Commitment Officer (PKK). The next day, Nuzulia, Helmi, and Isro submitted the company profile to the Ministry of Social Affairs.

Furthermore, in August 2020, Ardian and his wife, Indah Budi Safitri, met Nuzulia, Helmi, and Isro at Mall Kalibata, South Jakarta. During the meeting, Ardian was asked to complete a company profile and other requirements.

The equipment was later given to Isro. In addition, at the meeting, Ardian also discussed the commitment fee that must be given by Ardian which was immediately responded with the ability to fulfill it.

"A few days later the Defendant received a notification from Nuzilia that PT Tigapilar Argo Utama had been appointed as a provider of basic food assistance in handling the impact of the Corona Virus Disease 2019 (COVID-19) Ministry of Social Affairs and there was an Appointment Letter for Goods or Services Provider (SPPBJ) from the Ministry of Social Affairs. "said the prosecutor.

"Then the defendant was asked to come to the Ministry of Social Affairs office in order to verify the documents and capabilities of PT Tigapilar Argo Utama. So the defendant came together with Helmi to meet Adi and Matheus," continued the prosecutor.

A few days later, Ardian and all the goods supply companies that passed the verification attended the stage 9 social assistance briefing. Ardian also signed the SPPBJ and the Order Letter for the social assistance providers for 20,000 basic food packages.

Furthermore, in this indictment, Nuzulia and Helmy met Ardian and his wife. They reminded the defendant to immediately realize the obligation to provide a commitment fee to the Ministry of Social Affairs of 10 to 12 percent or IDR 30 thousand per food package.

The nominal amount reaches IDR 600 million. This is because PT Tigapilar Argo Utama has been appointed by the Ministry of Social Affairs in the process of procuring 20 thousand nine basic food packages.

"Apart from asking for the realization of the commitment fee money, Nuzulia asked for an operational fee of Rp. 40 million and an operational car. Therefore, on September 11, 2020, the defendant transferred Rp. 40 million in operating money to Nuzulia's account and rented a Honda Mobilio as an operational car," he said.

Thus, Ardian gave a commitment fee of IDR 600 million through Nuzulia in stages. First, the provision of Rp. 300 million. Then, the next day Rp. 100 million was given and finally Rp. 100 million, all of which were given in cash.

Meanwhile, the defendant also gave money by transferring three times to Nuzulia's account. The first time it was transferred was Rp. 50 million and twice Rp. 25 million.

After the phase 9 of the social assistance project was completed, Ardian also asked Metheus to pay for work. However, Matheus asked him to realize the commitment fee money.

So, Ardian contacted Nuzulia to realize the commitment fee money.

"Nuzulia sent money to the Defendant in the amount of Rp200 million through a transfer from Mandiri Account Number 1560016394654 in the name of Asep Wahyudi to BCA account Number 6760229642 in the name of Ardian Iskandar. Then asked the defendant to add Rp. 600 million so that the total amounted to Rp. 800 million to be given to Matheus by the defendant," said the prosecutor.

Furthermore, in stage 10 of the social assistance procurement, PT Tigapilar Argo Utama again received the project. Ardian was appointed as the provider of 50 thousand social assistance packages.

Thus, Ardian gave a commitment fee of Rp. 800 million to the Ministry of Social Affairs through Nuzulia. In fact, in stage 10, Ardian again sent Rp. 50 million to the Ministry of Social Affairs through Nuzulia.

After stage 10 was completed, Nuzulia gave Ardian Rp350 million which was then handed over to Matheus as a commitment fee.

Furthermore, Ardian gradually returned to provide commitment fee money in stages of IDR 1,325,000 or 1.35 billion to the Ministry of Social Affairs through Nuzulia for the 11th stage of the social assistance project.

Finally, in the 12th stage of the basos procurement, Matheus asked Ardian to provide a commitment fee. So, Ardian contacted Nuzulia to give it.

Until finally, Nuzulia gave Rp. 800 million to Matheus through Handy Rezangka.

"The money was given in connection with the appointment of the defendant through PT Tigapilar Agro Utama as a provider of basic food social assistance in the context of handling COVID-19 stage 9, stage 10, community stage and stage 12 as many as 115,000 packages," said the prosecutor.

For his actions, Ardian was charged with Article 5 paragraph (1) letter b of Republic of Indonesia Law Number 31 of 1999 concerning Eradication of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication Corruption Crime in Juncto Article 64 paragraph (1) of the Criminal Code.

Or Article 13 of Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Corruption Crimes as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Corruption in conjunction with Article 64 paragraph (1) Criminal Code.
