Anies, Tito, And The Head Of The COVID-19 Task Force Sued For PPKM
JAKARTA - DKI Jakarta Governor Anies Baswedan, Minister of Home Affairs Tito Karnavian, and Head of the COVID-19 Task Force Ganip Warsito were sued at the Jakarta State Administrative Court (PTUN) regarding the implementation of PPKM.
This lawsuit is included in case number 237/G/2021/PTUN.JKT with the plaintiffs Ferry Polii, et al. Currently, the status of the case is in preparatory examination.
The legal product being sued is the Decree of the Governor of the Special Capital Region of Jakarta Number 1182 of 2021 concerning the Implementation of Level 3 Community Activity Restrictions (PPKM) (along with its amendments or extensions) issued by Anies.
Then, the Instruction of the Minister of Home Affairs Number 47 of 2021 concerning the Enforcement of Restrictions on Community Activities Level 4, Level 3, and Level 2 Corona Virus Disease 2019 in the Java and Bali Regions (and their amendments or extensions) was issued by Tito.
Then, the Circular Letter of the Task Force for Handling Covid-19 Number 17 of 2021 concerning Travel Provisions for Domestic People during the Corona Virus Disease 2019 (COVID-19) Pandemic issued by Ganip.
In his lawsuit, the plaintiff asked the panel of judges to state that Anies, Tito, and Ganip had committed acts that were contrary to the 1945 Constitution, Law Number 36 of 2009 concerning Health, and Law Number 6 of 2018 concerning Health Quarantine.
The plaintiff also asked the panel of judges to declare null or void the legal product issued regarding the PPKM. Also, ordered Anies, Tito, and Ganip to revoke the regulation.
In addition, if the lawsuit is granted, Anies, Tito, and Ganip will be punished by paying the court fees filed by Ferry.
"Or if the court in this case has a different opinion, please give a fair decision (ex aequo et bono)," wrote the details of the case on the Jakarta Administrative Court website.
