Knock! Three Judges Sentenced By Non Palu Witness For Serious Violations
JAKARTA - The Judicial Commission (KY) and the Supreme Court (MA) held two sessions of the Honorary Council of Judges (MKH) and imposed non-hammer sanctions on three judges.
"The Court has decided to impose a severe non-hammer disciplinary sanction for two years at PT TUN Medan," said Assembly Chair Irfan Fachruddin in a written statement received in Jakarta, reported by Antara, Thursday, October 14.
On the first day, MA and KY held a MKH on the proposal of the Supreme Court against the FNN judges who were judges of the Tanjung Pinang Administrative Court. MKH imposed a two-year non-hammer sanction and was transferred to PT TUN Medan.
FNN was recommended permanent dismissal with pension rights due to absenteeism from serving as a judge since 2018. In its defense, FNN stated the reason for absenteeism was due to family reasons.
Two of their three children were declared to have special needs, so the psychiatrist advised FNN to always accompany their two children.
FNN has also verbally submitted a request for mutation when appearing before the Chair of the MA TUN Chamber. Then, FNN took a sabbatical and brought her children back to Medan, North Sumatra.
In its development, decisions related to promotions and transfers have not been issued, but FNN does not come to work without reporting it to its superiors, so that FNN is considered absent because it is not carrying out its duties as a judge.
FNN explained that while in Medan, he took care of his two children. FNN's statement was corroborated by FNN's husband who acted as a witness. FNN's husband also works as a judge at the Tubei District Court.
In its consideration, the Assembly considers what has been done by FNN is a serious violation. However, considering that FNN has served for 15 years as a judge and has never been sanctioned by the MA or KY, this is a mitigating factor.
Entering the second day, Wednesday, October 13, judges JW and MJP were given non-hammer sanctions on the basis of allegations of accepting bribes related to the case being handled at the Menggala District Court. SKB/IV/2009 and Number 02/SKB/P.KY/lV/2009 concerning Code of Ethics and Code of Conduct for Judges number 1 point 1.1.(2); number 2 point 2.1.(1); number 2 point 2.2.(1) jo. Article 5 paragraph (2) letter b, Article 6 paragraph (2) letter a, and Article 6 paragraph (3) letter a in conjunction with the Joint Regulations of MA and KY Number 02/PB/MA/lX/2012 and Number 02/PB/P KY/09/2012 concerning Guidelines for Enforcement of KEPPH.
Previously, KY recommended permanent dismissal with pension rights.
"Imposing sanctions to the reported parties with severe sanctions in the form of non-hammer judges for two years, without being paid office allowances, and being transferred to the North Maluku High Court," said Assembly Chair M. Taufiq HZ when reading the verdict.
The two judges reported to have met with the parties, asked for three cellphones, asked for a sum of money, and bargained with the litigants.
However, the reported parties were not proven to have received the cellphone and the amount of money in question. In its development, it was stated that the reported parties did not know about the results of the case decisions because when they entered the evidentiary process, both of them had been transferred to other courts.
