KPK Cannot Extend The Period To Prevent Harun Masiku Again

JAKARTA - The Corruption Eradication Commission (KPK) cannot again extend prevention or travel abroad against suspected former PDI-P legislative candidate Harun Masiku (HAR).

Harun Masiku is a fugitive in a bribery case related to the management of the interim replacement (PAW) for members of the Indonesian Parliament for the 2019-2024 period.

Referring to Article 97 of Law Number 6 Year 2011 concerning Immigration, the preventive period is valid for a maximum of 6 months and can be extended for a maximum of 6 months.

The KPK has extended detention against Harun twice, the last one from July 10, 2020 to the next 6 months. If this preventative period expires, the KPK cannot extend it any longer.

The letter of application for the extension of prevention has been sent by the KPK to the Directorate General of Immigration, Ministry of Law and Human Rights.

Previously, the Head of Public Relations and General Affairs of the Directorate General of Immigration, Arvin Gumilang, had also stated that the application for prevention could only be made twice or for 12 months.

"In total, it's only 12 months. The first prevention is 6 months, then the extension is 6 months," said Arvin through his statement some time ago quoted from Antara.

Acting KPK spokesman Ali Fikri said his agency continued to maximize the search for the suspect Harun.

"Currently, the KPK continues to maximize the search for the whereabouts of DPO (Harun Masiku)," said Acting KPK spokesman Ali Fikri when confirmed in Jakarta, Thursday.

He also stated that his agency had coordinated with the Police Criminal Investigation Unit, Interpol, and the Directorate General of Immigration to search for the suspect Harun.

"Coordination has been carried out, both with Bareskrim Polri, Interpol, and Immigration," said Ali.

The suspect Harun has been included in the Wanted List (DPO) status since January 2020. However, the KPK ensured that the investigation on Harun would continue.

"Therefore, of course the search will continue and the filing will also continue. The investigation is also ongoing, it does not mean that the suspect has not been found and then the file stops," Ali said.

In this case, PDIP cadre Saeful Bahri has been sentenced by the Panel of Judges at the Jakarta Corruption Court with a sentence of 1 year and 8 months in prison plus a fine of Rp150 million, a subsidiary of 4 months in prison, because he was proven to have participated in bribing former KPU Commissioner Wahyu Setiawan of Rp. 600 million.

Saeful was found guilty of committing a criminal act of corruption together with Harun of giving bribes to Wahyu through the intermediary of a former Bawaslu member or Wahyu's confidant, Agustiani Tio Fredelina.

Meanwhile Wahyu and Agustiani are still undergoing the trial process at the Jakarta Corruption Court.
