Suspected Rapists Of Biological Children In Aceh Freed By Syar'iyah Court, KPPAA: Totally Unfair
ACEH - The Aceh Women and Children Protection Commission (KPPAA) Firdaus Nyak Idin, assessed that the acquittal of the accused child rapist by the Aceh Syar'iyah Court (MS) was an unfair decision and seemed to ignore the results of the post-mortem.
"It's really an unfair decision, instead of siding with the child, the post-mortem results seem to have been ignored," said Firdaus Nyak Idin, in Banda Aceh, reported by Antara, Saturday, October 9.
Previously, the Aceh Syar'iyah Court acquitted the accused child rapist in Aceh Besar with the initials SUR (45), the defendant is the biological father of the victim.
The judge's acquittal was read out during the appeal hearing which took place at the Aceh Syar'iyah Court, Tuesday, September 29.
Firdaus said that so far the victim's family has submitted a report to Commission I of the Aceh DPR regarding the acquittal and KPPAA supports this step so that hopes for qanun revision are more open.
"Even in this decision, it seems that the victim's biological mother is considered to have reported the case because of hatred and revenge," he said.
Firdaus said the decision strengthens the assumption that there are systemic problems in the application of the qanun jinayat against perpetrators of child sexual violence.
Firdaus believes that the peak of this problem lies in the jinayat qanun, therefore this case should be able to make all parties aware that this qanun really needs to be revised.
"Articles related to sexual violence against children must be repealed, and judge MS does not have the capacity to hear cases of child sexual violence," he said.
Firdaus added that regarding the development of the revision of the jinayat law so far, his party has consolidated the four regions, namely the Lhokseumawe, North Aceh and Bireuen Regions.
Then, the Central Aceh Region, Bener Meriah. Then West Aceh Region, Nagan Raya, and Aceh Jaya, and finally Banda Aceh Region, Aceh Besar.
"Meanwhile, all support minor revisions (qanun jinayat law) related to cases of child sexual violence," said Firdaus.
