Denial Of The Attorney General's Office Called Breach In The Djoko Tjandra Case
JAKARTA - Head of the Attorney General's Office of Legal Handling Center, Hari Setiyono, has denied allegations that his party conceded in capturing the fugitive in the case of transfer of claim rights for Bank Bali, Djoko Tjandra, who is free to enter and exit Indonesia.
Hari said that what was called being conceded was when his party found out that Djoko Tjandra was in Indonesia but failed to arrest him.
"Sentences or words are broken, if you already know then you can't catch it, that means breaking. But if you don't know, then what person really means is what we are looking for, then with the information, so far we are still clarify the truth, "he said, in a virtual discussion entitled Ironi Djoko Tjandra & the Corruption Hunting Team, Saturday, July 18.
However, Hari admitted, catching fugitives, especially high-ranking fugitives, is not as easy as finding something that looks real right in front of your eyes. "I think looking for a convict, defendant or suspect is not as easy as looking for something that looks real. Moreover, let alone in Indonesia, especially when you can go abroad," he said.
Hari confirmed that the Attorney General's Office's intelligence team was working optimally to monitor the whereabouts of Djoko Tjandra. However, its whereabouts are not yet known.
"I think if we already know, we will immediately catch it. But once again there are certain times that our team may not be able to follow, in the sense that if you know beforehand, if you don't know the position is difficult too," he said.
Furthermore, Hari said, currently the Attorney General's Office is still gathering information about the whereabouts of Djoko Tjandra. Including the information circulating recently that Djoko Tjandra was in and out of Indonesia and is now in Singapore.
On the other hand, Hari was reluctant to explain the involvement of other agencies behind Djoko Tjandra's release from entering and leaving Indonesia. He said that he did not have the authority to take care of other agencies.
"We did not go there. What is clear, we have done it according to the procedure to request the completeness. Since 2009 there has been a red notice and we have done it," he said.
Attorney General's Office concededPreviously, Chairul Imam, the former Director of Investigation at the Attorney General's Office, spoke up. He considered, it is easy for big fugitives like Djoko Tjandra to enter and leave Indonesia not because of certain group games. However, it is due to the weak intelligence supervision of the Attorney General's Office.
"Because he was weak, he ended up being missed. I am not saying the game but the weakness of the intelligence (Attorney General's Office), evidence of weakness in regulations so this happened," he said.
Chairul admitted that he was quite confused to see Djoko Tjandra's ease in entering and leaving Indonesia. In fact, the Attorney General's Office should have been able to easily arrest Djoko Tjandra.
Based on Chairul's experience while in the Adhyaksa Corps, the Attorney General's Office can bring in fugitives even from countries that do not have an extradition treaty even with Indonesia.
"I see this has been conceded. Because several times we brought in fugitives from abroad and even from countries or places that do not have extradition agreements with us, we can succeed. So I don't know why now, I myself have a long time ago. outside the prosecutor's office, "he said.
Not only that, Chairul said, it is easy for big fugitives to enter and exit Indonesia because the entrances to the country are not closely monitored.
Moreover, said Chairul, as a maritime country with waters wider than the mainland, there are many mouse roads that can "support" Djoko Tjandra easily walk to Indonesia or vice versa.
"Entering Indonesia is actually something that is not too difficult. Just try from Singapore to Kuching (Malaysia), you can enter through West Kalimantan, Pontianak. You can also go through the rat road in Riau from Singapore, maybe you go through Tanjung Balai. "Tanjung Batu has a lot of smuggling boats that can be boarded," he said.
Chairul said that even fugitives could also use a cargo ship which would later lean on Pantai Mutiara and then be picked up by a speed boat. "So it is not easy to monitor (the entrances), it is difficult. But it must be done," he explained.
