Illegal Gun Ownership Case, Kivlan Zen Sentenced To 4 Months 15 Days In Prison
JAKARTA - The panel of judges at the Central Jakarta District Court decided to sentence Kivlan Zen to be guilty of illegal possession of firearms. Kivlan was sentenced to 4 months and 15 days in prison.
"The defendant was sentenced to imprisonment for 4 months and 15 days," said presiding judge Agung Suhendro during a trial at the Central Jakarta District Court, Friday, September 24.
In this decision, the panel of judges considered several things. For example, the mitigating factor is that he has never been sentenced to a criminal offense until he has contributed to maintaining peace and freeing Indonesians held hostage in the Philippines.
"The mitigating thing is that the defendant has never been convicted, the defendant has family responsibilities, that the defendant is of advanced age, that the defendant while serving as a member of the Indonesian Army, during his operations in Papua and Timor Timor received a promotion award," said Agung. .
"That the defendant was instrumental in the mission of maintaining peace for the settlement of the Nur Misuari MNLF rebellion with the Philippine government in 1995-1996. That the defendant had services to the state in the secret task of releasing Indonesian citizens who were held hostage in the Philippines in 2016," he continued.
Meanwhile, for incriminating considerations, Kivlan Zen did not admit his actions. In fact, the panel of judges is of the opinion that based on evidence the act of possessing weapons is illegal.
Then, in the decision it is also noted that the firearms currently used as evidence must be destroyed.
"Determining evidence in the form of one firearm, one long barrel and so on to be confiscated for destruction," said Agung.
In the verdict, Kivlan was found guilty of violating Article 1 paragraph (1) of Law Number 12/drt/1951 in conjunction with Article 55 paragraph (1) of the 1st Criminal Code or Article 1 paragraph (1) of Law Number 12/drt/1951 in conjunction with Article 56 paragraph (1) of the Criminal Code.
