Dewas Not Criminally Reporting Lili Pintauli To Prevent Conflict, Ex-KPK Director: Excuses

JAKARTA - The Corruption Eradication Commission (KPK) Sujanarko, former Director of Inter-Commission and Institutional Network Development (PJKAKI), believes that the reason for the KPK Supervisory Board's failure to report KPK Deputy Chairman Lili Pintauli Siregar to the criminal realm is far-fetched.

This was conveyed in response to the KPK Council's statement refusing to report Lili to other law enforcers because she had direct contact with the litigants, namely the inactive Tanjungbalai Mayor, M Syahrial.

The letter stated that reporting was not carried out because it could potentially cause a conflict of interest.

"Dewas doesn't want to report, among other things, maybe this COI (Conflict of Interest) is fabricated. Dewas has a supervisory function," said Sujanarko to reporters, Monday, September 20.

According to him, the KPK Council, which has a supervisory function, should report to other law enforcement officials on their findings. Moreover, the reply letter further strengthened Lili's suspicions.

"If you find an alleged act in the process of supervision (Dewas KPK, ed) you must report it to the APH (law enforcement officials)," said Sujanarko.

Even so, he admitted that until now he had not reported Lili to other law enforcement officers. Moreover, Indonesia Corruption Watch (ICW) previously reported Lili's actions to the Criminal Investigation Unit of the National Police.

"We are currently consolidating with our friends whether we still need to report to Police Headquarters," said Sujanarko.

As previously reported, the KPK Supervisory Board refused to report KPK Deputy Chair Lili Pintauli Siregar to law enforcement officers for alleged criminal offenses for meeting the litigants, namely the inactive Tanjungbalai Mayor, M Syahrial.

Through the letter, Indriyanto said that he refused to report Lili to other law enforcement officers because this report was not included in his duties.

"That the problem you convey is not related to the duties of the KPK Supervisory Board as stated in Article 37 B of Law No. 19 of 2019 concerning the Corruption Eradication Commission," said Indriyanto in the letter quoted on Sunday, September 19.

In addition, he also said that the reporting of alleged criminal acts carried out by Lili because she met M Syahrial was an ordinary offense, not a complaint offense.

"So that anyone can report to law enforcement and the Supervisory Board does not have to report it," said Indriyanto.

Next, Dewas also said that his party was not a State Civil Apparatus (ASN) so that they had no obligation to report Lili as regulated in Article 108 Paragraph (3) of the Criminal Procedure Code.

Finally, the Corruption Eradication Committee said that Novel Baswedan et al's request could not be carried out because if the KPK Council forwarded ethical decisions to law enforcement officers to be handled criminally, it would potentially cause a conflict of interest. The reason is that the ethics board has examined and decided what Lili did.

Not only that, the Corruption Eradication Commission (KPK) Council also considers that reporting the alleged crime committed against Lili based on fairness is inappropriate.

"That there is no provision in the Supervisory Board Regulation regarding the Code of Ethics and Code of Conduct that requires the Supervisory Board to report suspected criminal acts committed by the Corruption Eradication Commission Personnel.

For information, the KPK Council decided that Lili had violated ethics and gave severe sanctions in the form of cutting her basic salary by 40 percent for 12 months. He was found guilty of having direct contact with the inactive Tanjungbalai Mayor M Syahrial, who is a suspect in the case of buying and selling positions and abusing his position for personal gain.
