A Number Of KPK Employees Were Summoned By The Inspectorate For Supporting Novel Baswedan Cs

JAKARTA - A number of employees of the Corruption Eradication Commission (KPK) were reportedly summoned by the Inspectorate for supporting 57 employees who were dismissed at the end of September for failing the National Insight Test Assessment (TWK).

The head of the inactive KPK Anti-Corruption Learning Task Force, Hotman Tambunan, confirmed this information. He admitted that he heard that a number of his colleagues were summoned and examined by the Inspectorate.

"I heard that they were examined by the inspectorate," said Hotman when confirmed by reporters, Monday, September 20.

He explained that the form of support was actually through solidarity actions in the form of sending letters to the KPK leadership which were carried out twice.

"There were two times of solidarity, namely before being sworn in as ASN, they sent a letter to the leadership so that the inauguration was postponed and after the ORI and Komnas HAM decisions were issued, they sent a letter to the leadership to implement the recommendations," said Hotman.

Furthermore, he regretted the summons sent by the KPK Inspectorate to his colleagues. According to Hotman, the summons and examination should have been carried out by Tumpak Hatorangan Panggabean et al as the KPK Supervisory Board.

"If they are called to be examined, the inspectorate has nothing to do with it," he said.

Hotman also said that the KPK Inspectorate could not position itself according to the laws and regulations. Because, in the law, it is said that the ethical affairs of KPK personnel are the authority of the KPK Council.

"The law states that ethical matters are in the Dewas, not the inspectorate. The KPK is unique with Law 19 of 2019 and its Council. There is no need for an examination to be attended," he said.

It was previously reported that 57 employees were declared unable to work at the KPK because they could not become ASN according to the mandate of the KPK Law Number 19 of 2019 as of the end of September. The employees include senior KPK investigators Novel Baswedan and Ambarita Damanik, Chairman of the KPK Employee Forum Yudi Purnomo, KPK investigator Harun Al-Rasyid, and dozens of other names.

The anti-corruption commission argued that their inability to become ASN was not due to laws and regulations such as Perkom KPK Number 1 of 2021 but because of the results of their TWK assessment.

Not only that, the KPK also ensures that employees have been given the same opportunities even if they have passed the age limit or have stopped being ASN.

However, the decision caused a polemic considering the discovery of a number of maladministration and abuse of authority in the TWK process by the Indonesian Ombudsman. Not only that, Komnas HAM also found violations of 11 employees' rights.

So, this is a polemic. Moreover, the KPK and the State Civil Service Agency (BKN) do not want to follow up on corrective actions or recommendations issued by the Indonesian Ombudsman and Komnas HAM, respectively.
