Anies Clarification Oddities About Ancol Reclamation

JAKARTA - DKI Jakarta Governor Anies Baswedan has clarified the reclamation permit in Ancol, North Jakarta. However, DKI DPRD Commission B Member Gilbert Simanjuntak still felt that Anies's statement was anomalous.

In the video recording uploaded by the DKI Provincial Government, Anies said that the Governor's Decree Number 237 of 2020 can be used as a legal basis that meets the legal administrative requirements for the 155 hectare reclamation permit.

In fact, said Gilbert, the Ancol reclamation permit with a regulation in the form of a governor's decision was legally flawed. Anies must have a higher legal grip in the form of regional regulations (perda) regarding detailed spatial planning (RDTR) and zoning.

"How can the governorship become a legal basis? There must be a regional regulation that requires joint discussion between the DKI Provincial Government and the DPRD as a formulation," Gilbert told VOI, Monday, July 13.

In addition, Gilbert also questioned why Anies did not explain that the DKI Jakarta Provincial Government only received 5 percent ownership of the 35 hectares of land for K Island and 120 hectares of L Island.

The remaining 95 percent of the reclaimed land will be held and managed by PT Pembangunan Jaya Ancol as a Regional-Owned Enterprise (BUMD) DKI.

In fact, referring to Article 94 paragraph (6) of Government Regulation Number 54 of 2017 concerning Regional Owned Enterprises, land acquisition activities, namely reclamation, cannot be part of BUMD cooperation.

"One hundred percent of the land should absolutely belong to DKI. What is worrying about this distribution scheme is that Ancol will sell land to the private sector. In fact, no government land is allowed to be traded," said Gilbert.

As previously reported, DKI Jakarta Governor Anies Baswedan finally opened his voice on the Ancol reclamation plan. Anies claimed that the reason he gave permission for the expansion of the Ancol recreation area was to deal with the effects of the flood.

This is because, according to him, the land to be used in the 155 hectare reclamation project in Ancol is the result of river dredging from the Jakarta Emergency Dredging Initiative (JEDI) program and the Jakarta Urgent Flood Mitigation Project (JUFMP) which has been running since 2009.

"This mud is then used for the development of the Ancol area. So, this is an activity to protect Jakarta residents from floods," said Anies.

The permit for the extension of the Ancol area is stipulated in the Decree of the Governor of DKI Jakarta No. 237/2020 on February 24, 2020. The details are the permit for the expansion of the recreation area covering an area of 35 hectares for Dunia Fantasi (Dufan) recreation and 120 hectares for land expansion in the East Ancol area.

"Decree of the Governor number 237 of 2020 was issued, so that the land (dredging) can be utilized," said Anies.

Later, the reclaimed land will be used to build recreational facilities, including the Bird Park, the Floating Mosque, the Symphony of the Sea, the New Resto, and the eastern roundabout pedestrian. This facility will begin construction in 2021.

In addition, Dufan Hotel, Symphony of The Sea phase 3 (East Roundabout to dolphins) and stage 4 (dolphins to fantasy world) will also be built which are targeted to be built in 2022. Then, there is Ancol Residence starting to be built in 2021 until 2024 and Ocean Fantasy built from 2021 to 2023.
