Defendant In The Ambon Red And White Bridge Murder Case Sued 6 Years In Prison

AMBON - The Ambon Attorney General's Office has demanded that Rahman Bahari, a defendant in the persecution and murder of Firman alias Tole at Jembatan Merah Putih (JMP), be sentenced to six years in prison.

"Ask the panel of juvenile justice judges who examined and tried this case to declare the defendant legally and convincingly proven guilty of violating Article 338 in conjunction with Article 55 paragraph 1 of the Criminal Code in a subsidiary indictment," said prosecutor Chrisman Sahetapy, quoted by Antara, Wednesday, September 15.

Chrisman delivered this claim in a trial led by the Chief Justice of the Juvenile Court at the Ambon District Court Office, Rahmat Selang, accompanied by two member judges.

The panel of judges was also asked to stipulate that the period of detention that has been served by the defendant who was still a child was deducted entirely from the sentence imposed, and ordered that the child remain in custody.

There are also things that are aggravating the defendants being sentenced to prison because they were children who committed an act together with witness Ahdin Pattilouw alias Adi resulting in the death of the victim Firman alias Tole.

Meanwhile, the mitigating factor is that Rahman Bahari Ramadhan's child is a participant actor and commits some elements of a criminal act, while the main perpetrator is an adult witness.

The defendant is also young and has the opportunity to improve himself and a bright future.

Then in front of the child's trial, the defendant's father and mother along with the victim's mother had forgiven each other. However, the victim's biological mother did not forgive Ahdin's actions.

Based on the Circular Letter of the Deputy Attorney General for General Crimes at the Indonesian Attorney General's Office number B-1053/E/EJP/04/2012, dated April 4, 2012 addressed to the Heads of High Prosecutors throughout Indonesia regarding criminal charges against children half of the minimum threat for adults .
