UNJ Case Investigations Terminated, Observers Says It's Natural
JAKARTA - Polda Metro Jaya has stopped investigating the case of hand arrest (OTT) rector of Jakarta State University (UNJ) Komaruddin and officials of the Ministry of Education and Culture (Kemendikbud). The reason is because there is no solid evidence.
A criminal law observer from Al Azhar University, Suparji Ahmad said the police could have stopped the case. Moreover, there is no evidence that leads to a criminal act.
"The giving (handing over the money, red) is not proof. So that there is no element of corruption or gratification," Suparji told VOI, Friday, July 10.
According to him, even though UNJ and Kemendikbud officials were secured by the KPK with evidence of US $ 1,200 and Rp27 million in cash, there was no criminal evidence. So the police can stop this case.
"There is not enough evidence to be processed further. In principle, a case is terminated because there is no element of the speech so that it cannot be increased for investigation," said Suparji.
Previously reported, the Head of Public Relations of Polda Metro Jaya Kombes Yusri Yunus said that the investigation in this case was stopped because there was no indication of a crime. This was after his party examined witnesses. The termination of this investigation is contained in the Investigation Cessation Order (SP2-Lidik).
"With no corruption case found in the a quo case, investigators from the Corruption Eradication Agency of the Directorate of Criminal and Criminal Investigation of Polda Metro Jaya terminated the investigation in the context of legal certainty of this case," said Yusri in Jakarta, Thursday, July 9.
In making the decision to terminate the investigation, 44 people including two experts have been questioned. In fact, during the investigation process, Bareskrim and KPK participated in monitoring him.
"From the examination of existing expert witnesses, it was stated that this criminal act was not perfect. It was not included in the elements that were suspected," said Yusri.
