Anies Is Asked To Pay Off Formula E Commitment Fee Before Leaving His Tenure, PDIP Party: That's What Interpellation Is For
JAKARTA - A letter from the Youth and Sports Agency (Dispora) has circulated reminding the Governor of DKI Jakarta Anies Baswedan to pay off the Formula E commitment fee before his term of office expires in 2022.
In response to this, a member of the PDIP Party faction of the DKI Regional Representative Council (DPRD), Gilbert Simanjuntak, admitted that the plan to organize Formula E did raise a lot of question marks. Including how much DKI's ability to hold Formula E.
Therefore, from the outset, PDIP proposed the right of interpellation to ask Anies for information regarding Formula E, so that these questions could be answered.
"That really needs to be asked and let the Governor explain later. With this, it will further strengthen the impetus for carrying out the interpellation", Gilbert told VOI, Tuesday, September 14.
The requirement to pay off this commitment fee is stated in Article 92 Paragraph (6) of Government Regulation (PP) Number 12 of 2019 concerning Regional Financial Management.
It is stated that the budgeting period for multi-year activities does not exceed the end of the year the term of office of the regional head ends unless the activity is a national priority and/or national strategic interest.
This means that Anies must pay a commitment fee for the 5-year Formula E session before his term ends in October 2022. Because it has been agreed in the MoU.
Therefore, considering the pandemic conditions that resulted in the delay of Formula E, as well as sub-optimal regional income, Anies' ability to pay the commitment fee for 5 years of implementation is in doubt.
The problem is, if Anies cannot pay off the commitment fee when his term ends in October 2022, it will violate government regulations.
"The governor should follow the PP whose position is higher than the Governor's Instruction (Ingub). Skipping this means exceeding his authority. There is the potential for serious violations as a governor", Gilbert said.

As is known, Dispora DKI Jakarta sent a report letter regarding the plan for Formula E activities to Anies. This letter was sent on August 15, 2019. In the letter, the DKI Dispora reminded Anies to pay off the obligation to pay the Formula E commitment fee for 5 years.
The details are the 2019/2020 session of 20 million pounds sterling, the 2020/2021 session 22 million pounds, the 2021/2022 session 24.2 million pounds sterling, the 2022/2023 session 26.6 million pounds sterling, and the 2023/2024 session 29, 2 million pounds sterling.
So far, Anies has paid a commitment fee paid in 2019 of 20 million pounds sterling, approximately IDR 360 billion, a commitment fee in 2020 of 11 million pounds sterling or approximately IDR 200 billion, and a bank guarantee of 22 million pounds sterling or IDR 423 billion.
If Anies violates the agreement, then the planned Formula E performance will be labeled as a default and can be sued in international arbitration.
"With the signing of the MoU, the DKI Jakarta Provincial Government must be able to allocate a budget with the amount agreed. If this obligation cannot be carried out, it will be considered as an act of default which can be sued in international arbitration in Singapore", he wrote.
