Anies Will Blacklist Residents Of Prokes Violators, Ombudsman: No Regulations

JAKARTA - DKI Jakarta Governor Anies Baswedan plans to blacklist residents who violate the health protocols (prokes) in Jakarta during the pandemic.

In a sense, if there are residents who participate in activities or enter places that violate the prokes, they will be marked in the application and prohibited from going to various places.

In response, the Head of the Greater Jakarta Ombudsman, Teguh Nugroho, considered that Anies could not simply apply blacklist sanctions to residents. Because, there is no regulation that regulates this.

Currently, new government regulations and regional regulations regulate sanctions for legal entities that cause crowds. Then, individual sanctions for those who refuse vaccination or do not wear masks. However, there are no specific rules specifying sanctions for crowds.

"Government regulations and local regulations do not specifically mention sanctions for crowds of people. The problem with the blacklist for traveling lies in the regulations, where will the blacklist attempt go?" said Teguh when contacted, Friday, September 10.

In addition, Teguh views that the DKI Provincial Government does not have the authority to blacklist by preventing non-DKI residents from traveling outside Jakarta.

"Regionally, the DKI Provincial Government does not have the authority to prevent travel in the form of a blacklist for non-DKI residents who congregate in Jakarta," said Teguh.

"The blacklist's authority will also be problematic when the residents travel between cities outside DKI, such as air transportation in Banten or buses departing from buffer areas. The Provincial Government Authority does not have that far reach, unless it becomes a national policy," he continued. , Teguh views that the sanctions that can be applied to residents who violate health procedures, especially those who join the crowd, are the imposition of fines or social work, such as residents who do not wear masks.

DKI Jakarta Governor Anies Baswedan said that his party planned to impose sanctions on visitors to restaurants, cafes, and other places of business who violate health protocols.

Thus, later it will not only be the manager of the place of business who will be sanctioned when violating the health protocol, but the visitor will also be sanctioned.

The sanctions will be applied when the government has prepared its technology platform. Anies described that when entering a place, every visitor must scan a QR code like the PeduliLindung application.

Then, when the places they visit violate health protocols, they will be detected as violators too. Then, they will be blacklisted and not allowed to enter other places.

"Now the technology is being prepared. If you are in a place that has violated, before leaving you are scanned and then entered in the blacklist and can't go anywhere later. Wherever you go, you will be rejected because you are involved in committing violations ," explained Anies.
