AGO's Consideration Not Detaining Two Unlawful Killing Suspects

JAKARTA - The Head of the Legal Information Center (Kapuspenkum) of the Attorney General's Office, Leonard Eben Ezer Simanjuntak, said that his party did not detain two members of the National Police who are suspects in the unlawful killing case.

"The suspects were not detained because of several objective considerations," Leonard said when confirmed in Jakarta, reported by Antara, Tuesday, August 24.

Two suspects in the alleged crime of killing members of the FPI Laskar at KM 50 Toll Cikampek or known as unlawful killing, namely Brigadier FR and Ipda MYO are members of the Mobile Investigation (Resmob) Polda Metro Jaya.

Leonard explained that the objective considerations included that the suspects were still active members of the National Police.

In addition, the two suspects received a guarantee from him because they will not run away and will be cooperative during the trial.

"Objective considerations include, among others, that the suspects are still active members of the National Police, and have received guarantees from their superiors not to run away, and will be cooperative during the trial," said Leonard.

Leonard added that currently the prosecutor/public prosecutor has transferred the indictment and case files to the East Jakarta District Court.

With the submission of the indictment and case files to the East Jakarta District Court for trial and legal certainty.

The two members of the National Police were charged with the primary article of Article 338 of the Criminal Code jo. Article 55 paragraph (1) of the 1st Criminal Code and its subsidiary Article 351 paragraph (3) of the Criminal Code jo. Article 55 paragraph (1) of the 1st Criminal Code.

In this case, there were previously three members of the Polda Metro Jaya who were named suspects, one of which was EPZ. However, the person concerned died last April during the investigation process so that the case was terminated in accordance with Article 109 of the Criminal Procedure Code.
