H Island Cassation Is Granted, Anies Hopes To Win Another Reclamation Suit

JAKARTA - The Governor of DKI Jakarta, Anies Baswedan, won the appeal against the revocation of the Jakarta Bay H Island reclamation permit. This is in accordance with the ruling of the Supreme Court.

In the decision on register number 227 / K / TUN, Supreme Court Judge Yodi Martono Wahyunadi decided that PT Taman Harapan Indah's application as the developer of Pulau H was rejected, while Anies' appeal was granted.

"As for the verdict, reject the appeal from the petitioner for cassation I (PT Taman Harapan Indah). Kabul for cassation from the second cassation applicant (Governor of DKI Jakarta, Anies Baswedan, red). Cancel judex facti, adjudicate yourself, reject the lawsuit," said the contents of the ruling quoted from the MA's official website on Wednesday, June 23.

In other words, Anies's decision to cancel the reclamation construction permit carried out by the developer was legally correct. PT Taman Harapan Indah must stop reclamation activities on H. Island.

Responding to this, Anies appreciated the Supreme Court's decision because it was in line with the policies he was implementing. Anies hopes that the DKI Jakarta Provincial Government will win another claim on the island of reclamation.

"Alhamdulillah, it really means us. We appreciate the Supreme Court's decision and this is in line with our policy. God willing, other (lawsuit) that are in process will also be won," said Anies at City Hall.

The other disputed reclamation island cases are M Island, F Island, and Island I. In the M Island case, the panel of judges rejected PT Manggala Krida Yudha's claim as a developer. The developer then filed an appeal, but the results were rejected.

Meanwhile, in the F Island case, the PTUN Panel of Judges granted PT Agung Dinamika Perkasa's claim as a developer and Anies plans to fight back by filing an appeal to PTTUN.

Then, in the Island I case, the PTUN Panel of Judges granted PT Jaladri Kartika Pakci's claim as a developer. Anies then appealed to PTTUN and lost again. Now, Anies will submit an appeal for Island I to PTTUN.

For information, the claim for the reclamation permit began when Anies withdrew 13 reclamation island permits on September 6, 2018. PT Taman Harapan sued the revocation of the H Island reclamation permit to PTUN on February 18, 2019.

PTUN won the developer's lawsuit. Anies fought back again by filing an appeal to PTTUN. PTTUN decided to keep canceling the Decree on the revocation of the H Island reclamation permit and obliged Anies to revoke the SK. However, PTTUN did not order Anies to extend the reclamation permit for Pulau H.

Therefore, Anies and PT Taman Harapan Indah as the developer both submitted an appeal to the Supreme Court. The legal process went on, until finally the Supreme Court decided to grant Anies's appeal.
