Komnas HAM Findings Regarding TWK Of KPK Employees: BAIS TNI Uses BKN Letterhead When Testing Essays
JAKARTA - The National Human Rights Commission (Komnas HAM) said there was an attempt to obscure the truth that occurred during the National Insight Test Assessment (TWK) for employees of the Corruption Eradication Commission (KPK).
This finding was conveyed because of the use of letterhead from the State Civil Service Agency (BKN) in the implementation of essay tests in a series of assessments as a condition for the transfer of employee status to State Civil Apparatus (ASN).
"The fact that the BKN header was used for the essay test or the Personal List (DIP) was revealed and undeniable and believed to be a fact," Komnas HAM Commissioner M Choirul Anam said in an online press conference, Monday, August 16.
He explained that the facts were initially difficult to obtain considering that there were parties who often changed their statements so that there were discrepancies. However, Komnas HAM confirmed that the use of the letterhead was true and was concluded as an act of obscuring the truth.
"Because it seems as if it was made by BKN with certain goals and interests that are not in accordance with the usual process of an assessment for ASN employees or ASN candidates. Even though the assessment is a formal activity that has clear, precise, and strong legal legitimacy," said Anam.
He said this was different from what was done by the Army Psychology Service. In the TWK process, continued Anam, they correctly used IMB 68 tools, used their own institution's letterhead, and introduced the origin of their institution.
Anam also mentioned the implementation of covert and illegal actions in the form of field profiling which was only intended for certain employees.
"Even though it was confirmed that this process was not used in this assessment, there was even an affirmation that if it really happened then it would be illegal as well as the result," he said.
"This then became a serious problem because of the involvement of a number of parties in the process," Anam added.
So looking at the existing findings, Komnas HAM considers that TWK which is carried out as a process of transferring employee status does not fulfill its objectives because it does not have legal certainty, is unfair, and has no benefits for KPK employees.
"Especially (employees, ed) who do not meet the requirements (TMS). In addition, the organizers and organizers in the assessment process do not meet the principles of professionalism, transparency, and accountability," said Anam.
"So, it should be suspected that the process was carried out arbitrarily, not in accordance with the laws and regulations, and there was even an element of intentionality that was planned in its implementation and after its implementation," he concluded.
