JAKARTA - The owner of PT Borneo Lumbung Energi and Metal Tbk (BLEM) Samin Tan was sentenced to 3 years in prison plus a fine of Rp. 250 million, subsidiary to 6 months in prison. Samin Tan is considered proven to have bribed Eni Saragih when he was a member of Commission VII DPR from the Golkar faction worth Rp 5 billion.

"Demanding that the panel of judges at the corruption court (Tipikor) declare that defendant Samin Tan is proven legally and convincingly guilty of committing a criminal act of corruption on an ongoing basis. Sentencing the defendant Samin Tan with imprisonment for 3 years and a fine of IDR 250 million subsidiary 6 months confinement," said KPK public prosecutor Ronald F Worotikan at the Jakarta Corruption Court (Tipikor), as reported by Antara, Monday, August 16.

The claim is based on the first indictment of Article 5 paragraph 1 letter a of Law no. 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 64 paragraph 1 of the Criminal Code.

"The aggravating thing is that the defendant's actions do not support the government's program in eradicating corruption, the defendant does not openly admit his actions. The mitigating thing is that the defendant is polite in court, has never been convicted, still has 1 wife and 2 children dependents," he said. prosecutor.

In this case, Samin Tan was proven to have given money to Eni Maulani Saragih in total of IDR 5 billion in three stages.

First on May 3, 2018 amounting to IDR 1.2 billion; the second on 17 May 2018 in the amount of Rp. 2.8 billion; and on June 22, 2018 in the amount of Rp1 billion.

The goal is for Eni to help with the termination of the Generation 3 Coal Mining Concession Work Agreement (PKP2B) between PT AKT and the Ministry of Energy and Mineral Resources (ESDM) in Central Kalimantan.

Samin Tan is the "ultimate beneficiary owner" (UBO) of PT BLEM which is a "holding company" with a subsidiary PT Asmin Koalindo Tuhup (AKT) which is engaged in coal mining with mines in Murung Raya Regency, Central Kalimantan and PT Borneo Mining Services (BMS) which is engaged in the rental of heavy equipment in Murung Raya Regency, Central Kalimantan.

Initially, Samin Tan asked for the help of Golkar politician Melchias Markus Mekeng so that the termination of PT AKT's PKP2B could be reviewed by the Ministry of Energy and Mineral Resources.

Mekeng then introduced Eni Maulani Saragih who served as Deputy of Commission VII DPR. Samin Tan was then introduced to Eni.

Eni and Samin Tan met in February 2018. During the meeting, Eni explained to the defendant that she had discussed the PT AKT PKP2B issue with Ignatius Jonan where Ignatius Jonan suggested that the PT AKT lawsuit process in the PTUN be continued and promised if PT AKT's lawsuit was granted by the Jakarta Administrative Court. (first level), then Ignatius Jonan will provide the necessary recommendations.

Ignatius Jonan accompanied by the Director General of Mineral and Coal Bambang Gatot said that he had never made a promise as Eni Maulani delivered to Samin Tan.

Ignatius Jonan informed that the Ministry of Energy and Mineral Resources would seek a legal opinion from the Deputy Attorney General for Civil and State Administration (Jamdatun) of the Attorney General's Office.

With Eni's help, Eni then asked Samin Tan for some money.

"It is proven that Eni Maulani Saragih's efforts to help the defendant stop the termination of Generation 3 PKP2B between PT AKT and the Ministry of Energy and Mineral Resources in Murung Raya Regency, Central Kalimantan, as requested by the defendant. the money in stages with a total amount of IDR 5 billion," said the prosecutor.

Regarding this case, Eni Maulani Saragih was sentenced to 6 years in prison on March 1, 2019.
