The Polemic On The Status And Salary Of The Former Pinangki Prosecutor That Turns Out To End In 2020

JAKARTA - The convict in the case of managing the fatwa of the Supreme Court (MA), Pinangki Sirna Malasari, continues to reap polemics. After a long execution process, now news emerged that Pinangki was still a State Civil Apparatus (ASN) or civil servant and received a salary. In fact, the legal decision has been inkrah.

The news was first conveyed by the Coordinator of the Anti-Corruption Society (MAKI), Boyamin Saiman. The news was called based on various information received.

"Until now (Pinangki) has not been removed from his civil servant. Supposedly because he committed a criminal act of corruption, he should immediately be processed to be dishonorably discharged," said Boyamin at the Mata Najwa event, Wednesday, August 4.

In addition, the dismissal of Pinangki should be done as soon as possible. Because, currently Pinangki is only temporarily suspended so that they still receive their rights.

"It's true that you still get a salary from the state. It will be quickly dismissed with disrespect in order to prevent the state from financing or paying people whose names are corrupt," said Boyamin.

With this news, a number of assumptions emerged. One of them is about Pinangki which is privileged.

A legal observer from Trisakti University, Abdul Fickar Hadjar, said that the allegation could happen. The allegation was based on the handling of Pinangki.

"Yes, you can (Pinangki is privileged)," said Fickar.

In addition, the privilege of Pinangki, said Fickar, is also suspected because it has become part of the Attorney General's Office (AGO). This means that there is an effort to ease the burden on Pinangki, who was a prosecutor.

"There is an element of esprit de corps, so it seems special," he said.

Shortly after the news emerged, the Attorney General's Office (AGO) issued a rebuttal statement. All Pinangki rights were confirmed to have been terminated since September 2020.

"We convey that Pinangki Sirna Malasari's salary has not been received (dismissed) since September 2020, while the performance allowance and meal allowance have also been no longer received by the person concerned since August 2020," said Head of the AGO, Leonard Eben Ezer Simanjuntak.

Then, regarding Pinangki who is still an ASN or civil servant, Leonard said that the news was also not true. The reason is that the illegal dismissal of Pinangki is being processed.

"In the process stage and in the near future, a Decision to Dismiss With Respect as a Civil Servant (PNS) will be issued to the person concerned," said Leonard.

In addition, based on the decision of the Attorney General of the Republic of Indonesia Number 164 of 2020 dated August 12, 2020, Pinangki has been suspended. That is, since then Pinangki no longer works as a prosecutor.

"Pinangki has been suspended from his position as a civil servant and automatically he is no longer a prosecutor," said Leonard.
