MK Rejects Denny Indrayana's Lawsuit, Orders KPU To Determine Uncle Birin As Winner Of South Kalimantan Gubernatorial Election
JAKARTA - The Constitutional Court (MK) stated that it did not accept the application or lawsuit for the dispute over the election of the Governor and Deputy Governor of South Kalimantan (Kalsel) submitted by the candidate pair number 2, namely Denny Indrayana and Difriadi Darjat.
"Declare that the applicant's application cannot be accepted," said Constitutional Justice Anwar Usman when reading the verdict at the Jakarta Constitutional Court building, quoted by Antara, Friday, July 30.
In its ruling, the Constitutional Court declared that the South Kalimantan Provincial KPU's decision No. 37/PL.02.6-Kpt/63/Prov/VI/2021 was valid regarding the Determination of the Recapitulation of Vote Counting Results after the Constitutional Court's Decision in the 2020 Election of Governor and Deputy Governor of South Kalimantan on 17 June 2021.
The Constitutional Court in its decision also ordered the respondent, namely the KPU of South Kalimantan Province to immediately determine the pair of candidates elected in the 2020 Election of Governor and Deputy Governor of South Kalimantan.
Previously, the Denny Indrayana and Difiradi camps sued the results of the re-voting (PSU) for the election of the Governor and Deputy Governor of South Kalimantan to the Constitutional Court on June 21.
In the main reading of the petition during the trial on Wednesday, July 21, Bambang Widjojanto as attorney for Denny Indrayana and Difriadi mentioned several allegations of fraud that affected the vote acquisition in the PSU for the 2020 South Kalimantan Governor and Deputy Governor Elections on 9 June 2021.
The results of the Constitutional Court's decision were decided in a Consultative Meeting of Judges by eight Constitutional Justices, namely Anwar Usman, as Chairman and Member, Aswanto, Arief Hidayat, Enny Nurbaningsih, Daniel Yusmic P. Foekh, Manahan MP Sitompul, Saldi Isra, and Suhartoyo, respectively. as a Member on Monday 26 July 2021.
"It was said in the Plenary Session of the Constitutional Court which was open to the public on Friday, July 31, 2021. It was finished at 16.02 WIB by the eight constitutional judges above," said Anwar Usman.
