There Is No Evidence Of The Urgency Of Criminal Sanctions For Prokes Violators, The Revision Of The DKI Jakarta COVID-19 Regional Regulation Is Not Ratified Today

JAKARTA - The DKI DPRD Formation of Regional Regulations (Bapemperda) did not approve the revision of Regional Regulation (Perda) Number 2 of 2020 concerning COVID-19 Response.

The revision of the COVID-19 Perda was carried out because the DKI Provincial Government wanted to add criminal sanctions for violating health protocols and make the Satpol PP have the authority as investigators.

In fact, previously Deputy Chairperson of the DKI DPRD Mohamad Taufik said the COVID-19 regional regulation would be ratified and promulgated today, July 29, 2021.

However, the Head of the Bapemperda of the DKI DPRD, Pantas Nainggolan, said that the target for the ratification of the COVID-19 regional regulation today was not carried out because the discussion had not been completed.

"So, (the ratification of the COVID-19 Regional Regulation) has no target because we still want to first evaluate the implementation of Regional Regulation Number 2 of 2020," Pantas said when contacted by VOI, Thursday, July 29.

On Wednesday, July 21, DKI Jakarta Governor Anies Baswedan delivered a speech explaining the purpose of the revision of the COVID-19 Regional Regulation in a plenary meeting with the DPRD.

Then, on Friday, July 23, the DKI DPRD Bapemperda held a discussion meeting with the ranks of the DKI Provincial Government. During the meeting, DPRD felt that the data presented was not comprehensive.

The DKI Provincial Government has not explained in detail about violations of health protocols, from the first violators to those who do it repeatedly. Therefore, the DPRD does not yet know the urgency of imposing criminal sanctions for violators of this health protocol.

Finally, the meeting was postponed until the DKI Provincial Government was able to describe the data in detail and prove that those violating the health protocols in Jakarta were not deterred even though they had received administrative sanctions. This is because this can prove the urgency of the imposition of criminal sanctions.

Until now, Pantas said, the DKI Provincial Government has not yet submitted the requested data report.

"We are waiting for a report from the DKI Provincial Government regarding the implementation of the mandate of Perda 2/2020. Yesterday, the executive had delivered his presentation. Then, we asked for it to be evaluated, we asked for comprehensive data on the implementation of the regional regulation so that we can evaluate it. Proper.

It is known, DKI Jakarta Governor Anies Baswedan wants criminal sanctions for people who violate health protocols during the pandemic in the revised Regional Regulation Number 2 of 2020.

In the draft regional regulation amendment, Anies added two articles between Articles 32 and 33, namely Articles 32A and 32B. This article adds a criminal threat.

He explained, if there are violators who repeat the act of not wearing a mask after being given social and administrative work sanctions, they will be sentenced to a maximum of three months in prison or a maximum fine of Rp. 500,000.

Furthermore, for business actors such as offices, industry, hotels, transportation, and restaurants who repeat acts of violating health protocols and have received a license revocation, they will be sentenced to a maximum imprisonment of three months or a maximum fine of IDR 50,000,000.
