There Is No Mechanism For The Transfer Of Employee Status To Cause Polemic TWK KPK

JAKARTA - The Ombudsman of the Republic of Indonesia said that the polemic of the National Insight Test Assessment (TWK) for the Corruption Eradication Commission (KPK) employees was caused by the absence of a status transfer mechanism.

"I have to say up front that today we don't have a mechanism called transition. There is a selection mechanism for civil servants to civil servants or from people who are not civil servants to civil servants. But that is the selection mechanism regulated in Law Number 5 of 2014," said the member RI Ombudsman Robert Na Endi Jaweng at a press conference delivering the final results of the examination of KPK employee complaints which was broadcast online, Wednesday, July 21.

He then explained that the selection mechanism certainly could not be used in the transfer status of the anti-corruption commission. Moreover, based on statutory regulations, employees do not carry out an entry selection but convert from an independent status to a state civil apparatus (ASN).

"Although the Ombudsman is not included in the substance assessment related to the mandate of Law 19 (UU 19 of 2019) and PP 41, this is not a selection but a conversion. This is not a recruitment but a transition," said Robert.

Reflecting on this incident, the Ombudsman encouraged the government through the KemenPANRB and the State Civil Service Agency (BKN) to draw up rules related to the transition of status as experienced by KPK employees.

"KemenPANRB and BKN have prepared a roadmap related to future personnel management related to transitions, related to conversion, not selection, not recruitment if it is already in the ASN Law and PP regarding PNS and P3K management," said Robert.

The drafting of the rules is considered important considering that there are still many state institutions and independent commissions that have their own staffing regulations and may, due to changes in the rules, suddenly enter the executive clump such as the anti-corruption commission.

"So we hope that what happened at the KPK will not be repeated in the future," he said.

Previously reported, the Ombudsman found maladministration in the process of implementing the National Insight Test Assessment (TWK) for employees of the Corruption Eradication Commission (KPK). This was conveyed by the Chairman of the Indonesian Ombudsman Mokhammad Najih on Wednesday, July 21.

"In general, we found maladministration from the results of the examination," Najih said at an online press conference broadcast on the Indonesian Ombudsman's YouTube account.

He explained that his institution focused on examining allegations of maladministration on the first three issues. First, in a series of policy formation processes, the process of transitioning the status of KPK employees to State Civil Apparatus (ASN).

Second, in the process of implementing a series of status transfers and finally at the stage of determining the results of the TWK assessment. "Three things that the ombudsman found potential for maladministration," he said.

Furthermore, these findings will be submitted to the KPK leadership, the head of the National Civil Service Agency (BKN), and President Joko Widodo.

"We have submitted a letter of recommendation to the president so that the findings of maladministration found by the Ombudsman's examination can be followed up and further steps taken," said Najih.
