The Judge's Reason for Reducing Pinangki Sentence Was Considered Fascinating, Law Enforcement Persons Should Be Severely Punished

JAKARTA - Academician from the Faculty of Law from Andalas University (Unand) Padang, West Sumatra, Feri Amsari, said that the sentence handed down to Pinangki prosecutor Sirna Malasari was more severe because of his status as a law enforcement officer.

"The judge does not consider Pinangki as a law enforcement officer. If law enforcement officers commit a crime, it is always aggravated because of the provisions of the Criminal Code", he said when contacted in Jakarta, reported by Antara, Tuesday, June 15.

Therefore, the Executive Director of the Center for Constitutional Studies Andalas University saw that there were irregularities in the judge's decision, which did not aggravate the sentence but instead eased the sentence of the Pinangki prosecutor by considering the status of women.

According to Feri, the reasons presented by the judge seemed to be looking to cut Pinangki's sentence from 10 years to four years.

Then the consideration of Pinangki's status as a mother with a four-year-old child, Feri assessed, was also not linear with her status as a law enforcement officer.

He is worried that if the reason for her status as a mother is taken into consideration, it has the potential to smooth out corruption crimes in the future.

Therefore, what needs to be seen from the Pinangki case is the power or authority she has, namely as a prosecutor and not solely because of the status of women and a mother.

"Because it will override the important or substantial value of this case", he said.
