JAKARTA - Andreau Misanta Pribadi as the personal secretary of the former Minister of Maritime Affairs and Fisheries said he had reported income from a bank guarantee of a lobster seed exporting company worth Rp48 billion to Edhy Prabowo.
"My verbal report was given to Pak Edhy, I conveyed that after I recovered from COVID-19, I also prepared a presentation of Pak Edhy Prabowo's 1 year performance as a minister in the Advanced Indonesia Cabinet including PNBP (Non-Tax State Revenue) in the form of a bank guarantee worth IDR 48 billion ," Andreau said at the Jakarta Corruption Court (Tipikor), as reported by Antara, Tuesday, June 15.
Andreau was a witness for Edhy Prabowo who was accused together with five other defendants of receiving US$77 thousand and Rp. 24,625 billion, bringing the total to around Rp. 25.75 billion from lobster seed exporters (BBL).
"But I haven't had time to submit the written report yet," said Andreau, who is also the head of the Due Diligence Team for Lobster Cultivation Fisheries Business Licensing.
According to Andreau, the PNBP withdrawal was withdrawn from the company based on Government Regulation No. 75 of 2015 concerning Tariffs on Types of Non-Tax State Revenues Applicable to the Ministry of Maritime Affairs and Fisheries.
"In Chapter 7 of the PP, it is stated that Rp. 250 per 1,000 head is paid as PNBP to the state and additional instruments are submitted to the Ministry of Finance. The Ministry of Maritime Affairs and Fisheries submits PNBP that has not been regulated to the Ministry of Finance where lobster seeds are included as 'high value' so an additional is proposed. outside of PNBP regulated in PP," added Andreau.
Although still submitting a revised PP to the Ministry of Finance, KKP has issued a letter to the Head of the Fish Quarantine Agency, Quality Control and Safety of Fishery Products (BKIPM) of the Ministry of Fisheries and Marine Affairs Rina and the Head of the Center for Fish Quarantine, Quality Control and Safety of Fishery Products Jakarta I ( Soekarno-Hatta) to withdraw bank guarantees from lobster seed exporting companies.
"The company entered a bank guarantee and deducted it according to the amount of exports and state money received, what I received was IDR 48 billion according to the amount that had been exported, so the difference in the selling price in the destination country minus the purchase price at the fishermen, for sand lobster seeds, IDR 1000 was charged and for other types of pearls are charged Rp. 1,500," said Andreau.
According to Andreau, KKP will continue to withdraw bank guarantees from exporting companies even though the revision of the PP PBNB is still in the harmonization stage at the Ministry of Law and Human Rights.
"As far as I remember the follow-up after the meeting, Bank BNI finally said okay, this is already a strong basis for notification of the Ministry of Finance's reply letter so that BNI becomes the recipient bank in the form of a bank guarantee," said Andreau.
Andreau then issued a basic letter of tariffs that had been agreed between the ministries, namely Rp. 1000 for sand lobster seeds and Rp. 1500 for pearl lobster seeds.
"I sent a letter to quarantine, namely Mrs. Rina and Mr. Habrin and then forwarded a letter of commitment from the quarantine and exporters because it was the quarantine party who collected PNBP," added Andreau.
The indictment states that Edhy Prabowo directed the Secretary General of the Ministry of Maritime Affairs and Fisheries Antam Novambar to make an official memorandum to the Head of BKIPM Number: ND.123.1/SJ/VII/2020 dated July 1, 2020 regarding the Follow-up to the Implementation of the Regulation of the Minister of Maritime Affairs and Fisheries No. 12 of 2020 amid Management of Lobster, Crab and Crab.
Furthermore, the Head of the Center for Fish Quarantine, Quality Control and Safety of Fishery Products Jakarta I (Soekarno-Hatta) Habrin Yake signed a Letter of Commitment with all BBL exporters as the basis for issuing bank guarantees at BNI Bank which were used as BBL export guarantees.

The bank guarantee deposit was made even though the Ministry of Finance has not yet issued a revised Government Regulation on Non-Tax State Revenue (PNBP) for exports of BBL so that the total amount of money collected in the bank guarantee at BNI bank is Rp.
The KPK itself has confiscated a bank guarantee worth IDR 52,319 from the Gambir branch of the BNI bank in the investigation of the case.
