DIESEL S.p.A. Files Suit in Commercial Court to Cancel Ramayana's "DIESEL HOUSE" Trademark

JAKARTA - The leading Italian fashion company, DIESEL S.p.A., has officially filed a lawsuit for cancellation of the registration of the trademark "DIESEL HOUSE BY RAMAYANA LESTARI SENTOSA Tbk" at the Commercial Court at the Central Jakarta District Court.

The lawsuit against PT Ramayana Lestari Sentosa Tbk was registered with case number 88/Pdt.Sus-HKI/Merek/2026/PN Niaga Jkt.Pst. DIESEL S.p.A. appointed Legal Representative H. Amris Pulungan, S.H. et al. from the Pulungan, Wiston & Partners (PWP) law firm to handle this case.

The Reason for the Trademark Complaint and Alleged Bad Faith

In its lawsuit, DIESEL S.p.A. argued that the registration of the trademark with IDM001116734 has similarities in essence with the DIESEL trademark and its variations. This can be seen from the use of the dominant element in the form of the word "DIESEL".

Apart from the issue of similarity, the plaintiff also based his application on the provisions of the protection of well-known brands and alleged bad faith, as stipulated in Law No. 20 of 2016 concerning Brands and Geographical Indications.

DIESEL S.p.A. requests the Central Jakarta Commercial Court to:

Stating DIESEL and its variations as well-known brands. Stating that there is a similarity in essence between the disputed trademark and the trademark owned by the plaintiff. Cancel the registration of the trademark No. IDM001116734 for Classes 5, 18, 25, 35, and 36.

Jurisprudence and the Interrelationship of Related Parties

A dispute over a similar brand name has occurred previously. The Central Jakarta Commercial Court through Decision No. 31/Pdt.Sus-Merek/2019/PN.Niaga.Jkt.Pst has canceled the "DIESEL HOUSE" trademark in the name of Agus Makmur. The decision was upheld to the cassation level (No. 280 K/Pdt.Sus-Merek/2020) and the review (No. 40 PK/Pdt.Sus-HKI/2021).

For information, Agus Makmur is known to be a Related Party to PT Ramayana Lestari Sentosa Tbk., namely serving as President Director as well as one of the company's shareholders.

The trial process for the Intellectual Property Rights (IPR) dispute trial was held for the first time on Tuesday, August 11, 2026 at the Commercial Court at the Central Jakarta District Court.

In accordance with the principle of a trial that is open to the public, the public, academics, legal practitioners, and media colleagues are invited to accompany the trial process while maintaining order and respecting the independence of the Panel of Judges.

Statement of the Legal Representative of DIESEL S.p.A.

The Legal Counsel of DIESEL S.p.A., H. Amris Pulungan, S.H. et al. from Pulungan, Wiston & Partners (PWP), emphasized that this legal step was taken to ensure the protection of the rights to the brand of his client in Indonesia.

"Indonesia has legal instruments that provide protection for registered brands and well-known brands, including the principles that have developed through court decisions. We fully respect the ongoing examination process and leave the assessment and judgment of this case to the panel of judges," said Amris.

According to Amris Pulungan, he has also brought DIESEL, S.p.A, to file a cancellation lawsuit against the registration of the DIESEL HOUSE trademark in the name of PT Ramayana Lestari Sentosa Tbk. This lawsuit has been registered with Number 88/Pdt.Sus-HKI/Merek/2026/PN Niaga Jkt.Pst. and is currently in the process of being examined by the Commercial Court at the Central Jakarta District Court.

He added that this information was conveyed to provide public education regarding the principle of protection of intellectual property rights as well as the importance of upholding the principle of presumption of innocence during the legal process.
