Nadiem's Lawyer Reported to Peradi about Celetukan 'Yang Mulia Takut Ya?, This is the Response of PN Jakpus

JAKARTA - The Central Jakarta District Court has honored the complaint of two lawyers, Nadiem Anwar Makarim, Dodi Abdul Kadir and Ari Yusuf Amir, to the Indonesian Bar Association (Peradi) Honor Council.

PN Jakpus spokesman Muhammad Firman Akbar said the report was the right of every citizen and community institution to submit complaints through available channels according to applicable regulations.

"The alleged violation of the Code of Ethics for Lawyers is entirely the authority of the honorary council of the lawyer organization to investigate and decide it," said Firman as reported by ANTARA, Tuesday, July 7.

Therefore, he emphasized that the Jakpus PN was not in a position to assess, respond to, or provide an opinion on the complaint material in order to respect the independence of the advocacy organization as fellow law enforcement officers.

Regarding the request for the revocation of permits or imposition of sanctions against lawyers, he continued, the authority, including dismissal, is also on the honorary council of the lawyer organization in accordance with applicable regulations and is not the authority of the court.

He conveyed that the authority of the presiding judge to maintain order in the courtroom only applies during the trial, whereas the trial of the Nadiem case has been completed with the pronouncement of the verdict.

Regarding the course of the trial, Firman emphasized that the order and honor of the trial were always maintained based on the applicable procedural law and everything that happened in the trial was recorded in the trial minutes as an official document.

Because the main case is still in the legal grace period and has not yet become legally binding, the PN Jakpus considers it inappropriate to respond to the material of the case in the public space in order to maintain the honor of the judicial process and the principle of presumption of innocence.

"PN Jakpus is committed to continuing to maintain independence, impartiality, and mutual respect between fellow law enforcement officers, namely judges, public prosecutors, and advocates, within the framework of dignified law enforcement," he emphasized.

The reporting of the lawyer Nadiem was carried out by the group of the Indonesian Anti-Corruption Civil Society Network (Jamsaki), on Thursday (2/7).

The report was triggered by the two lawyers' statements after the trial of the verdict in the alleged corruption case of the procurement of Chromebooks, which ensnared Nadiem, at the Corruption Crime Court at the Jakpus PN, Tuesday (30/6).

At that time, the legal team asked the question "Why do you have to rush, Your Honor, are you afraid?" to the panel of judges when they left the courtroom.

Jamsaki assessed that the statement was unethical and contrary to Article 269 of the Criminal Procedure Code, insulting the court room (contempt of court), and damaging the integrity of the judiciary.

Jamsaki urged Peradi to take firm action and revoke the lawyers' practice licenses if they were proven to have violated the Code of Ethics for Lawyers.
