Minister of Human Resources and Social Security Honored the Judge's Decision to Sentence Nadiem Makarim to 10 Years in Prison
JAKARTA - Minister of Law Supratman Andi Agtas respects the legal process and court rulings in corruption cases that ensnared former Minister of Education, Culture, Research, and Technology Nadiem Anwar Makarim.
"That is not the task and function of the Ministry of Law. But whatever the context, we appreciate the court's decision," said Supratman as reported by ANTARA, Friday, July 3.
He said that parties who are dissatisfied with the decision still have the right to take legal action in accordance with the provisions, including through appeals and cassation.
In this case, both Nadiem and the public prosecutor (JPU) have stated that they will appeal the decision of the panel of judges.
After the verdict at the Corruption Court at the Central Jakarta District Court, Tuesday (30/6), Nadiem said that an appeal was filed to fight for the truth and provide support to professionals and parties who he thought were criminalized.
"I will not stop. Please pray, please support, please vote for you, and please have your courage," said Nadiem.
Meanwhile, the Head of the Legal Information Center of the Attorney General's Office, Anang Supriatna in Jakarta, Thursday (2/7), said that one of the considerations in the JPU appeal memorandum was the status of the house detention which is currently being carried out by Nadiem.
"In the decision it is stated that they remain in custody. Currently, the detainees being held are house detainees. Later in the appeal memorandum we will consider," he said.
The panel of judges sentenced Nadiem to 10 years in prison after finding the former Minister of Education and Culture for the period 2019-2024 guilty of committing corruption in the education digitization program through the procurement of Chromebook laptops and Chrome Device Management (CDM) in the Ministry of Education and Culture environment. 2019-2022.
In addition to imprisonment, Nadiem was sentenced to a fine of Rp1 billion, subsider 190 days in prison, and an additional penalty in the form of payment of compensation of Rp809.59 billion, subsider five years in prison.
The panel of judges stated that the substitute money was imposed because Nadiem was proven to have received Rp809.59 billion from PT Aplikasi Karya Anak Bangsa (PT AKAB) through PT Gojek Indonesia. It is also stated that most of PT AKAB's funds come from Google's investment of US$786.99 million.
In this case, Nadiem's actions were considered to have caused a loss of state funds of IDR 1.56 trillion.
The losses arose, among other things, because the procurement of learning facilities based on information and communication technology in the form of Chromebook laptops and CDM in the 2020, 2021, and 2022 budget years was not in accordance with the planning and principles of procurement of goods and services.
The panel of judges also stated that the crime was committed together with three other defendants who had been decided in separate cases, namely Ibrahim Arief alias Ibam, Mulyatsyah, and Sri Wahyuningsih, as well as with Jurist Tan who is still at large.
For his actions, Nadiem was found guilty of violating Article 3 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Corruption as amended by Law Number 20 of 2001 in conjunction with Article 55 paragraph (1) of the Criminal Code.
