Visit The Office Of The Ombudsman, Deputy Chairperson Of The KPK Clarifies TWK Including The Legal Basis
JAKARTA - Deputy Chairman of the Corruption Eradication Commission (KPK) Nurul Ghufron fulfills the call of the Indonesian Ombudsman to clarify the National Insight Test Assessment (TWK) which is suspected of maladministration. This allegation emerged after 75 KPK employees who were declared not to have passed the employee status transfer test submitted their complaints.
"KPK has accepted the invitation for clarification from the Ombudsman of the Republic of Indonesia today starting at 13.30 WIB. What are the questions to the KPK? Of course, starting from the formulation of the policy on transferring the status of KPK employees to ASN starting from its policies, regulations, to its implementation and after the Constitutional Court's decision," said Ghufron in an online press conference broadcast on the Indonesian Ombudsman's YouTube, Thursday, January 10.
There were three points conveyed in his clarification to answer the alleged maladministration as reported by the employee.
First, Ghufron emphasized that the KPK has legal standing to carry out the transfer of employment status from independent to ASN based on Article 1 Paragraph 6 of the Juncto Article 3 KPK Law whose duration rules are also regulated in Article 69C of the KPK Law Number 19 of 2019.
From the law then technically it is further regulated in PP 41 of 2020 which is then regulated in more detail in Perkom Number 1 of 2021. "The basis for making the Perkom is Article 6 of PP 41 of 2021. That is the basis of the KPK's authority to regulate, implement starting from policies, regulations, implementing the transfer of the status of KPK employees to ASN," he explained.
Second, Ghufron also explained the procedure for establishing commission regulations and their implementation, which included the implementation of the TWK to the implementation of the appointment of KPK employees to become ASN.
Finally, he emphasized that the policy-making process until the implementation of the transfer of employment status was carried out by paying attention to transparency. Moreover, all KPK employees can read the draft commission regulations without being covered up.
"At the time of making the Perkom transparent. In what activities was the transparency established? Every Perkom at the KPK was always uploaded to the KPK mailing list so that all parties at the KPK knew the draft Perkom," he said.
Not only that, he also said that the preparation of the commission's regulations had been discussed with a number of experts such as constitutional law expert from Gadjah Mada University Oce Madril and public policy expert Eko Prasojo.
In addition, the KPK also invited Bulog, which had carried out a similar status transfer from non ASN to ASN and KemenPANRB. "That shows that we are transparent, we participate in the preparation of both regulations and implementation," said Ghufron.
Although he has conveyed his clarification, he still invites the Indonesian Ombudsman to complete the investigation of alleged maladministration in the TWK process.
"We have been carried out by the Ombudsman of the Republic of Indonesia and for that we welcome and welcome further activities or activities that will be carried out," said Ghufron.
Previously reported, representatives of 75 KPK employees who did not pass the TWK reported their leadership to the Ombudsman regarding allegations of maladministration. One of the reports the employees reported relates to the leadership's decision to deactivate them.
For information, the National Insight Test was attended by 1,351 KPK employees. Of these, 1,274 people were declared eligible.
Meanwhile, 75 employees including Novel Baswedan, Chairman of the KPK Employee Forum who is also investigator Yudi Purnomo, Director of Anti-Corruption Campaign and Socialization of the KPK Giri Suprapdiono, Head of the KPK Task Force Harun Al-Rasyid, and Director of PJKAKI Sujarnarko were declared ineligible (TMS). While the other two employees did not attend the interview test.
According to the employees who were declared unsuccessful, there were a number of anomalies in the implementation of this assessment. Including, questions that are considered to violate the private sphere, such as whether they are willing to become a second wife and if they are dating, what to do.
